Анотація
Стаття присвячена зарубіжному досвіду боротьби з бандитизмом, а також імплементації міжнародних норм у вітчизняне законодавство. Запропоновано оперативні заходи, що не потребують перебудови основ кримінальної юстиції України, які дають змогу здійснити пряму рецепцію міжнародного досвіду. Автор дійшов висновку, що для становлення та розвитку вітчизняної системи боротьби зі злочинністю загалом і таким її організованим проявам, як бандитизм, для розроблення та впровадження в діяльність відповідних суб’єктів нових, ефективних форм і методів запобігання бандитизму необхідно вивчати та впроваджувати у практику позитивний міжнародний досвід, що включає методичні напрацювання і практичні прийоми у зазначеній сфері, з урахуванням національних особливостей, зумовлених попереднім розвитком нашої держави та сучасними трансформаційними процесами, що відбуваються в усіх сферах суспільного життя нашої країни. The article is devoted to the foreign experience
of combating banditry, as well as the
implementation of international norms in national
legislation. Operational measures are
proposed, which do not require restructuring
of the criminal justice bases of Ukraine, which
make it possible to carry out a direct reception
of international experience. The author came
to the conclusion that for the formation and
development of the national system of combating
crime in general and its organized manifestations,
such as banditry, for the development
and implementation of relevant, new, effective
forms and methods of prevention of banditry, it
is necessary to study and put into practice a positive
international experience, including methodological
experience and practical techniques
in the fi eld, taking into account national peculiarities
caused by the previous development of
our country and modern transformations social
processes occurring in all spheres of public life
in our country.
Given the foreign experience of preventing
organized crime, the author considers it appropriate
to consider the possibility of implementing
measures in Ukraine aimed at logistical, fi -
nancial, personnel support of the fi ght against
organized crime; organization of a system for
collecting, processing, storing tactical and strategic
information on the state of crime in general,
organized crime, as well as information on
the activities of specifi c criminal groups, their
leaders, crimes that commit such groups or are
preparing to commit them. In our view, this is
a necessary prerequisite for obtaining the necessary
evidence on the culpability of criminal
groups (or their individual members) in committing
crimes; active implementation of victimbased
prevention based on the priority of the
rights of victims of banditry, conducting rehabilitation
work with the victims of crime, compensation
for the harm caused to the victims of
banditry; implementation of situational crime
prevention measures; involvement of the general
public, political and public fi gures in the
prevention work; taking measures to prevent
corruption in the higher echelons of power,
courts, etc; coordination between organized
crime and gangster prevention.
