Дезертирство в Україні: кримінально-правовий та кримінологічний аспект

Монографія присвячена вивченню дезертирства в Україні. У роботі досліджено кримінально-правовий та кримінологічний аспект дезертирства в Україні, а також теоретичні і практичні проблеми запобігання його вчиненню у Збройних Силах України та інших військових формуваннях, що створені відповідно до законодавства, у результаті чого обґрунтовано низку положень і висновків, нових у концептуальному плані й важливих для юридичної науки та практики.
The monograph is devoted to the study of desertion in Ukraine. The work examines the criminal-legal and criminological aspect of desertion in Ukraine, as well as theoretical and practical problems of preventing it in the Armed Forces of Ukraine and other military formations created in accordance with the legislation, as a result of which a number of provisions and conclusions, new in the conceptual plan and important for legal science and practice, are substantiated.
Міжнародний досвід корпоративного управління підприємствами із забезпечення кібербезпеки

Стаття присвячена трансформації корпоративного управління в умовах цифровізації та зростання кіберзагроз. Показано, що традиційний акцент на контролі фінансів і прозорості поступається місцем управлінню цифровими ризиками, захисту даних і забезпеченню стійкості бізнесу. Розглянуто зовнішні й внутрішні кіберзагрози, їх види та наслідки для корпоративного сектору. Проаналізовано міжнародний досвід США, ЄС та провідних корпорацій (Microsoft, Siemens, Samsung, IBM), що інтегрували кібербезпеку у стратегії управління. Запропоновано архітектурну модель корпоративного управління з урахуванням цифрових ризиків, яка передбачає багаторівневий підхід, інтеграцію стандартів ISO/IEC та рекомендацій NIST. Зроблено висновок, що адаптація міжнародних стандартів ISO/IEC 27001, NIST CSF, GDPR та NIS2 до національних реалій та їх впровадження у бізнес-середовище дозволить підвищити рівень захисту компаній і прискорить їх інтеграцію у глобальну економіку.
The article explores the essence of corporate governance transformation in the digital age and the impact of cyber threats on modern business models. Traditional approaches focused on financial control and transparency no longer meet the requirements of the globalized information environment. Currently, the key tasks of corporate governance are digital risk management, information asset protection, ensuring cyber resilience and building stakeholder trust. The classification of cyber threats is revealed: external and internal. The most dangerous forms are described in detail – financial attacks, data theft, industrial espionage and disruption of business processes. The consequences of cyber threats are outlined: direct financial losses, reputational losses, legal liability of management. The international experience of integrating cybersecurity into corporate governance is analyzed. The principle of "cyber expertise in the board of directors" and mandatory disclosure of information about cyber risks of US companies are studied. It is indicated that information security standards play a key role in EU companies. An analysis of the practice of leading international corporations led to the conclusion that cybersecurity is considered a strategic priority integrated into all levels of management. An architectural model of corporate governance taking into account digital risks is proposed, which covers the supervisory, strategic, operational and behavioral levels, as well as interaction with the external environment. It is based on institutional, process, cultural and systemic approaches. It is concluded that an effective corporate governance model in the digital age is impossible without the integration of international standards, the development of a corporate cybersecurity culture and the harmonization of national legislation with European practices. It was concluded that adapting the international standards ISO/IEC 27001, NIST CSF, GDPR, and NIS2 to national realities and their implementation in the business environment will increase the level of protection of companies and accelerate their integration into the global economy.
Забезпечення прав та свобод дитини під час воєнного стану

В статті досліджено забезпечення прав та свобод дитини під час воєнного стану. Забезпечення прав і свобод дітей в умовах воєнного стану є дуже важливим з кількох причин. Так, воєнний стан створює надзвичайні умови, які загрожують основоположним правам дитини на життя, освіту, охорону здоров’я та захист від насильства. Діти примусово переміщуються, розлучаються зі своїми сім’ями або стають жертвами експлуатації. По-друге, як держава-учасниця Конвенції ООН про права дитини, Україна зобов’язана гарантувати захист прав дітей навіть під час збройного конфлікту. Це вимагає адаптації національного законодавства та розробки спеціалізованих механізмів допомоги дітям у таких ситуаціях. По-третє, нинішній воєнний стан в Україні, спричинений зовнішньою агресією, підкреслює необхідність вжиття ефективних заходів для захисту дітей таких як, створення безпечних зон, надання психологічної підтримки та забезпечення базових потреб, таких як харчування та медична допомога.
The article examines the provision of children’s rights and freedoms during martial law. Ensuring the rights and freedoms of children under martial law is very important for several reasons. Thus, martial law creates extraordinary conditions that threaten the fundamental rights of children to life, education, health care and protection from violence. Children are forcibly displaced, separated from their families or victims of exploitation. Secondly, as a state party to the UN Convention on the Rights of the Child, Ukraine is obliged to guarantee the protection of children’s rights even during an armed conflict. This requires the adaptation of national legislation and the development of specialized mechanisms to help children in such situations. Third, the current state of war in Ukraine, caused by external aggression, emphasizes the need to take effective measures to protect children, such as creating safe zones, providing psychological support and providing basic needs such as food and medical care.
Вплив установ виконання покарань і попереднього ув’язнення на криміногенну ситуацію в Україні

Вже давно відзначено, що установи кримінально-виконавчої системи та попереднього ув’язнення здійснюють неабиякий вплив на стан злочинності, зокрема й рецидивної, у тих регіонах, де вони розташовані. Проте і досі той факт, що зазначені установи сприяють створенню специфічного криміногенного фону, який негативно позначається на криміногенній обстановці в тих чи інших адміністративно-територіальних одиницях, не підтверджується математичними розрахунками і методом картографування.
It has long been noted that facilities of the penal correction system and pre-trial detention facilities have a considerable impact on the crime situation, including recidivism, in the regions where they are located. However, even to this day, the fact that these facilities are contributive to the emergence of a specific criminal background negatively affecting the crime situation in certain administrative territorial areas, is not confirmed by mathematical calculations and mapping methods.

У підґрунті процесу розробки ефективної стратегії зменшення можливостей вчинення злочинів має знаходитися інформаційна модель наявної криміногенної ситуації. Цією моделлю охоплюються як кількісно-якісні показники злочинності, так і визначальні закономірності її розвитку й відтворення.
The complex process of developing effective measures covered by the strategy to reduce the possibility of committing crimes should be based on an objective information model of the
existing criminal situation in the country.
