Матеріал присвячено дослідженню питань кримінального провадження щодо діяння, кримінальна протиправність якого була встановлена законом, що втратив чинність, з урахування рішення КСУ України та змін до КПК України. Здійснено оцінку обґрунтованості виокремлення кримінального провадження щодо діяння, кримінальна протиправність якого була встановлена законом, що втратив чинність, як особливого провадження з позицій теорії та підстав диференціації та юридичної техніки. Також виокремлено проблемні питання регламентації цього провадження. Сформульовано пропозиції змін та доповнень до кримінального процесуального законодавства.
The material is devoted to the investigation of issues of criminal proceedings regarding an act, the criminal illegality of which was established by a law that has lost its validity, taking into account the decision of the Supreme Court of Ukraine and changes to the Criminal Procedure Code of Ukraine. An evaluation of the validity of separating the criminal proceedings regarding the act, the criminal illegality of which was established by the law that has lost its validity, as a special proceeding from the standpoint of the theory and grounds of differentiation and legal technique was carried out. Problematic issues of the regulation of this proceeding are also highlighted. Proposals for changes and additions to the criminal procedural legislation have been formulated.
Кримінальне провадження в Україні в режимі воєнного стану

The chapter is devoted to the study of military transformations of criminal proceedings in Ukraine after the start of a full-scale war with the russian federation. Such aspects of crimi-nal proceedings under martial law as the history of the formation of “wartime” provisions in legislation; evaluation of the evidence obtained under Art. 615 of the Criminal Procedure Code of Ukraine; ensuring the balance of security interests and human rights during the transformation of the military section of the Criminal Procedure Code of Ukraine; other transformations of criminal proceedings caused by the war; implementation of provisions governing cooperation with the International Criminal Court in the Criminal Procedure Code of Ukraine; prospective criminal procedural legislation of Ukraine in the context of the relevant practice of the ECtHR are considered. It was stated that before the start of the full-scale war with the russian federation, the criminal proceedings under martial law had a very limited and fragmented nature. A dif-ferentiated order of criminal proceedings began to form only after a full-scale war, and this rule-making process continues to this day. The main transformations of the “military” section of the Criminal Procedure Code of Ukraine are subjected to critical analysis, in particular, the issue of starting a pre-trial investigation under martial law, delegating powers of the investigating judge, applying mea-sures to ensure criminal proceedings, terms of pre-trial investigation and court proceed-ings, administration of justice under martial law, implementation of the right to protection in the conditions of martial law, recovery of lost materials, etc. The normative regulation of cooperation with the International Criminal Court and its compliance with the Rome Statute were separately investigated. Some author’s proposals regarding changes and additions to the Criminal Procedure Code of Ukraine.
Розділ присвячено дослідженню воєнних трансформацій кримінального провадження в Україні після початку повномасштабної війни з Російською Федерацією. Такі аспекти кримінального провадження в умовах воєнного стану, як історія становлення положень «воєнного часу» у законодавстві; оцінка отриманих доказів за ст. 615 Кримінального процесуального кодексу України; забезпечення балансу інтересів безпеки та прав людини під час трансформації військової частини Кримінально-процесуального кодексу України; інші трансформації кримінального провадження внаслідок війни; імплементація положень, що регулюють співпрацю з Міжнародним кримінальним судом, у Кримінально-процесуальному кодексі України; розглядаються перспективи кримінально-процесуального законодавства України в контексті відповідної практики ЄСПЛ.

У енциклопедичному словнику систематизовано більше 1350 термінів і категорій ПДР (в редакції від 09.04.2026 року № 427) з врахуванням вимог Законів України «Про дорожній рух» та «Про деякі питання використання транспортних засобів, оснащених електричними двигунами, та внесення змін до деяких законів України щодо подолання паливної залежності і розвитку електрозарядної інфраструктури та електричних транспортних засобів», державних стандартів, інших нормативно-правових актів з БДР. Розкрито такі аспекти забезпечення БДР як регулювання дорожнього руху, надання домедичної допомоги потерпілим при ДТП, будова та експлуатація транспортних засобів, охорона праці водія, юридична відповідальність за порушення ПДР, правоохоронна діяльність поліцейських, організація освітнього процесу з підготовки кандидатів у водії.
The encyclopedic dictionary systematizes more than 1,350 terms and categories of traffic laws (as amended on April 9, 2026, No. 427), taking into account the requirements of the Laws of Ukraine "On Road Traffic" and "On Some Issues of the Use of Vehicles Equipped with Electric Engines and Amendments to Some Laws of Ukraine Regarding Overcoming Fuel Dependence and Development of Electric Charging Infrastructure and Electric Vehicles", State Standards, and others regulatory legal acts on BDR. Such aspects of road traffic regulation as road traffic regulation, provision of first aid to victims of road accidents, construction and operation of vehicles, driver occupational safety, legal responsibility for road traffic violations, law enforcement activities of police officers, organization of the educational process for training candidate drivers are disclosed.
