Анотація
Поняття «примус», «примушування» та «насильство» належать до числа ключових в кримінальному праві, від їх правильного розуміння залежать і вірна кваліфікація діяння, і визначення ролі співучасника, і справедливе покарання. Однак визначення вказаних понять не утворюють системи і часом суперечать один іншому. Завданнями кримінально-правової науки в даному випадку є чітке їх розмежування, чітка та детальна трактовка, що виключає всі можливі протиріччя в судово-слідчій практиці.
Відповідно поставленої проблематики у статті розглядаються точки зору різних вчених стосовно поняття психічного насильство саме у формі примусу, як обставини, що виключає злочинність діяння. Розглянуті найважливіші форми и представлени пропозиції, щодо виділення та зауваження основних її проявів. The concepts of "coercion", "coercion" and "violence" are among the key ones in criminal law, the correct qualification of the act, the definition of the role of an accomplice, and a fair punishment depend on their correct understanding. However, the definitions of these concepts do not form a system and sometimes contradict each other. The tasks of criminal law science in this case are their clear demarcation, clear and detailed interpretation, which excludes all possible contradictions in judicial and investigative practice. Accordingly, the article considers the points of view of various scientists regarding the concept of mental violence in the form of coercion, as a circumstance that excludes the criminality of the act. The most important forms are considered and proposals are presented regarding the selection and observation of its main manifestations.
