Анотація
На сучасному етапі розвитку держави громадськість активно сприяє процесам політичної демо-
кратизації, набуття державою ознак правової,
обстоюючи матеріальну і духовну незалежність
людини від держави, домагаючись правової гарантії
такої незалежності, захисту приватних і суспільних
інтересів людей. Водночас має бути зворотний зв’язок державних інститутів, зокрема поліції з громад-
ськістю, оскільки правова держава має реагувати на
запити і потреби асоційованого громадянства, видавати відповідні законодавчі акти та стежити за їх
виконанням.
Наукові дослідження, присвячені питанням взаємодії поліції з інститутами громадянського суспіль-
ства, дотепер не втрачають своєї актуальності. Це
зумовлено чинником переорієнтування завдань, що
постають перед сучасними правоохоронними орга-
нами, удосконалення взаємодії органів поліції з інститутами громадянського суспільства є необхідною
умовою формування позитивного іміджу поліції,
довіри населення до правоохоронних органів.
Вимоги сьогодення потребують удосконалення
діяльності правоохоронних органів, орієнтація яких
спрямована на надання якісних соціально-сервісних
послуг населенню, зумовлює необхідність вироблення
нових форм та методів діяльності, оновлення наявних підходів до організації взаємодії з громадськістю.
У статті узагальнюється досвід Німеччини, США,
Великобританії, Швеції щодо взаємодії інститутів
громадянського суспільства з поліцією. Обґрунтовується висновок, що, маючи різні традиції, історичний
досвід, зарубіжні країни використовують доступні їм
ресурси та інновації для максимального підвищення
ефективності забезпечення громадської безпеки
в інтересах громадянина і суспільства, здійснивши
перехід від «кризової моделі» попередження злочинності в межах упровадження соціального партнерства
поліції і громадян.
Досліджено стратегію «партнерство заради спокою», апробовану в країнах англосаксонської правової
системи, яка розрахована на усвідомлення поліцейськими необхідності налагодження взаємодії з населенням. Така модель взаємодії поліції з громадою передбачає налагодження довірливих стосунків із
населенням шляхом безпосередньої співпраці та діалогу.
Охорона правопорядку полягає у визнанні того,
що відповідальність за протидію злочинності несе
не лише поліція, а й інші представники суспільства.
Зазначається, що в умовах сьогодення взаємодія поліції з громадськістю має плануватися і формуватися
на ефективній науково обґрунтованій управлінській
основі, адже оптимізація взаємодії поліції з громадськими інституціями у контексті правоохоронної
діяльності спрямована на основну мету – надати
нового імпульсу вітчизняним формам співпраці, що
існували раніше, та запровадити перевірений часом
зарубіжний досвід участі громадськості в правоохоронній та правозахисній діяльності з використання
консультативного механізму та співпраці з населенням у галузі охорони публічного порядку.
Проаналізовано позитивний досвід розвинених
країн щодо взаємодії громадянських інститутів
і поліції, зроблено низку висновків щодо послідовної
адаптації та застосування деяких із них в Україні. At the present stage of development of the state,
the public actively promotes the processes of political
democratization, the acquisition of legal signs by the state,
defending the material and spiritual independence
of man from the state, seeking legal guarantees of such
independence, protection of private and public interests.
At the same time, there should be feedback from public
institutions, including the police, and the public, as the rule
of law must respond to the requests and needs of associate
citizenship, issue relevant legislation and monitor its
implementation.
Research on police interaction with civil society
institutions has not lost its relevance to date. This is due
to the factor of reorientation of the tasks facing modern
law enforcement agencies, improving the interaction
of police bodies with civil society institutions is a necessary
condition for forming a positive image of the police, public
confidence in law enforcement agencies. The requirements of today require the improvement
of law enforcement agencies, whose focus is on providing
quality social services to the population necessitates
the development of new forms and methods of activity,
updating existing approaches to organizing interaction
with the public.
The experience of Germany, the USA, Great
Britain, and Sweden on the interaction of civil society
institutions with the police is summarized. The conclusion
is substantiated that, having different traditions,
historical experience, foreign countries use available
resources and innovations to maximize the effectiveness
of public safety for the benefit of citizens and society,
moving from the "crisis model" of crime prevention in
the implementation of social partnership between police
and citizens.
The strategy of "partnership for peace", tested in
the countries of the Anglo-Saxon legal system, which is
designed to make police aware of the need to interact
with the public. This model of police interaction with
the community involves building trusting relationships
with the public through direct cooperation and dialogue.
The protection of law and order is to recognize that
the responsibility for combating crime lies not only
with the police but also with other members of society.
It is noted that in today's conditions the interaction
of police with the public should be planned and formed
on an effective scientifically sound management basis,
because the optimization of police interaction with
public institutions in the context of law enforcement
is aimed at giving new impetus to existing and existing
forms of cooperation sometimes foreign experience
of public participation in law enforcement and human
rights activities in the use of the advisory mechanism
and cooperation with the public in the field of public order.
The positive experience of developed countries
in the interaction of civic institutions and the police
is analyzed, a number of conclusions are made on
the consistent adaptation and application of some of them
in Ukraine.
As the positive experience of foreign countries shows,
Ukraine needs to strive to create a modern and effective
law enforcement system capable of effectively protecting
the rights, freedoms and interests of people, focusing on
the needs of not only the state but also the public.
In today's environment, police interaction with
the public should be planned and formed on an effective
science-based management basis, because optimizing
police interaction with public institutions in the context
of law enforcement is aimed at the main goal – to give
new impetus to domestic forms of cooperation. public
participation in law enforcement and human rights activities
on the use of the advisory mechanism and cooperation with
the public in the field of public order.
