Анотація
У статті розглядається досвід деяких зарубіжних країн щодо регламентації інституту випробування у кримінальному законодавстві. Увага зосереджена на тому, що у кримінальному законодавстві багатьох країн визначається велика кількість найменувань аналізованого інституту. Встановлено, що термінологія, яка використовується законодавцем у різних країнах щодо інститутів, які за своїм ступенем та змістом є видами умовного незастосування (невиконання) призначеного судом покарання теж досить різними. Досліджено досвід таких країн як Англія, США, Швеція, Німеччина, Франція, Литва, Білорусь. The article examines the experience of some foreign countries in terms of the regulation of the institution of testing in criminal law. Attention is focused on the fact that the criminal legislation of many countries defines a large number of names of the analyzed institution. It has been established that the terminology used by the legislator in different countries in relation to institutions, which, in their degree and content, are types of conditional non-application (non-fulfillment) of the punishment imposed by the court, are also quite different. You can also do it with good health. The experience of such countries as England, USA, Sweden, Germany, France, Lithuania, Belarus has been studied.
