Анотація
У статті розглядається психологічна система прийняття рішень слідчим суддею під час розгляду клопотань про надання дозволу на проведення необхідних слідчо-розшукових дій (НСРД). Визначено психологічні чинники, що впливають на процес прийняття цього рішення. Стаття досліджує вплив психічних процесів та особистісних властивостей на прийняття рішень під час розгляду клопотання про надання дозволу на проведення необхідних слідчо-розшукових дій (НСРД). Зокрема, розглядаються когнітивні процеси, такі як відчуття, сприйняття, пам'ять, увага, мислення
і уява, які є важливими для прийняття рішень. Також зазначаються індивідуальні особливості особистості, такі як рівень домагань, переваги та когнітивні стилі, які також впливають на процес прийняття рішень. Стаття акцентує увагу на суб'єктивних факторах, таких як освіта, професійний досвід, психологічні властивості та підходи до прийняття рішень (інтуїція, судження, раціональність), які також впливають на процес розгляду клопотання. Особистісні особливості, зокрема впевненість у собі та своїх переконаннях, відіграють важливу роль під час прийняття рішень.
Особлива увага приділяється особливостям мислення слідчого судді, таким як глибина, широта, швидкість і гнучкість, а також процесу оцінки доказів, який вимагає логічного та розумового аналізу ролі та значення зібраних доказів. Розрізнення між дослідженням і оцінкою доказів вимагає складної розумової діяльності. Стаття підкреслює важливість дотримання конституційних норм та прав людини під час розгляду клопотань про проведення НСРД. Автор ідентифікує три функціональні підсистеми психологічної системи винесення ухвали слідчим суддею після розгляду клопотань про проведення НСРД. Перша підсистема – індивідуально-особистісні компоненти – описує властивості особистості, які впливають на прийняття рішень. Друга підсистема – компоненти взаємодії з середовищем – розглядає вплив особистості на пошук стратегій, дій, оцінку та прогнозування наслідків рішень. Третя підсистема – компоненти рішучості – стосується координації вибору, його реалізації та прогнозу наслідків. Аналізуючи ці аспекти, стаття підкреслює важливість забезпечення системи гарантій і прав людини в процесі прийняття рішень під час НСРД. The article explores the psychological decision-making
system of an investigating judge during the consideration
of motions for granting permission to conduct necessary
investigative and detective actions. The psychological
factors influencing the process of making this decision are
determined. It examines the influence of mental processes
and personal characteristics on decision-making in
the context of reviewing motions for granting permission
for investigative (detective) actions. Specifically, cognitive
processes such as perception, attention, memory, thinking,
and imagination, which are essential for decision-making,
are discussed. Individual personality traits, such as levels
of aspirations, preferences, and cognitive styles, are also
noted to impact the decision-making process.
The article emphasizes subjective factors, including
education, professional experience, psychological
attributes, and decision-making approaches (intuition,
judgment, rationality), which also influence the motion
review process. Personal traits, particularly self-confidence
and convictions, play a significant role in decision-making.
Special attention is given to the characteristics
of the investigative judge's thinking, such as depth, breadth,
speed, and flexibility, as well as the process of evidence
evaluation, which requires logical and cognitive analysis
of the role and significance of the collected evidence.
Distinguishing between the investigation and evaluation
of evidence necessitates complex cognitive activity. The article emphasizes the importance of adhering
to constitutional norms and human rights during
the consideration of motions for conducting necessary
investigative and detective actions.
The author identifies three functional subsystems
of the psychological decision-making system
of an investigative judge after the review of motions for
investigative (detective) actions. The first subsystem,
individual-personality components, describes
personality traits that influence decision-making. The
second subsystem, components of interaction with
the environment, examines the impact of the individual
on the search for strategies, actions, evaluation,
and prediction of decision outcomes. The third subsystem,
components of determination, relates to the coordination
of choice, its implementation, and the anticipation
of consequences.
By analyzing these aspects, the article emphasizes
the importance of ensuring a system of guarantees
and human rights in the decision-making process during
investigative (detective) actions.
