Роль шлюбного договору у визначенні частки подружжя в спадковій масі: судова практика

Abstract

Дослідження присвячене комплексному аналізу ролі та значення шлюбного договору у механізмі визначення частки подружжя в складі спадкової маси з урахуванням сучасної судової практики в Україні. Особлива увага приділяється співвідношенню договірного регулювання майнових відносин подружжя та імперативних норм спадкового права, що набуває особливої актуальності у випадках смерті одного з подружжя та відкриття спадщини. У роботі розкривається правова природа шлюбного договору як складного юридичного інструменту, що поєднує елементи цивільно-правового зобов’язання та сімей-но-правового договору, а також аналізуються межі автономії волі сторін у контексті спадкових право-відносин.

The study is devoted to a comprehensive analysis of the role and significance of the marriage contract in the mechanism of determining the spouses' share in the inheritance mass, taking into account modern judi-cial practice in Ukraine. Special attention is paid to the correlation of the contractual regulation of prop-erty relations between spouses and the imperative norms of inheritance law, which becomes especially relevant in cases of the death of one of the spouses and the opening of the inheritance. The work reveals the legal nature of the marriage contract as a complex legal instru-ment that combines elements of a civil-law obligation and a family-law contract, and also analyzes the lim-its of the autonomy of the parties' will in the context of inheritance relations.
