dc.description.abstractАвтором розглянуто сучасний стан професійної діяльності слідчих і необ- хідність відповідати сучасним інформаційним технологіям, які плинні та мін- ливі. Для цього працівник органів досудового розслідування повинен бути спроможним чітко визначати, обмірковувати та виконувати професійні функ- ції сфери діяльності. У зв’язку із реорганізаційними етапами у Національній поліції України виникає нагальна потреба уточнення й узагальнення функцій слідчого відповідно до нових законодавчих змін у державі. Тому автором визначені єдині та уніфіковані функції працівників слідства органів досудового розслідування з урахуванням чинного законодавства Укра- їни та сфер діяльності: особистісної, соціальної та діяльнісної. Проаналізовано нормативно-правові акти, які визначать діяльність слідчого на предмет забезпе- чення груп функцій. Дослідивши тлумачення терміна «функція», ми визначили, що вона реалі- зовується шляхом виконання обов’язків у певних напрямах роботи. Зосереджу- ється увага саме на обов’язках працівника органу досудового розслідування при виконанні посадових інструкцій відповідно до кола напрямів. Запропоновано сфери діяльності функцій класифікувати на три сфери (осо- бистісну, соціальну та діяльнісну) та п’ять груп, які поділяються на певні під- види: гносеологічну (аналітичну, оцінну, креативну), операціональну (вико- навчу, комунікативну, пошукову, розшукову, засвідчувальну, педагогічну), стратегіко-тактичну (діагностичну, прогностичну, рефлексійну, технологічну), управлінську (організаційну, розподіляючу, контролюючу, регулятивну, координаційну), профілактичну (запобіжну, захисну). Доведено, що усі групи та їхні підвиди взаємопов’язані між собою і взаємозалежні та тільки у єдиному комплексі визначають єдину систему професійної діяльності слідчого органів досудового розслідування. This work deals with the current state of professional activity of investigators and the need to be at a high level meeting the requirements of modern information technologies, which are unstable and changeable. In this regard, the pre-trial investigation officer must be able to clearly define, reflect and perform the professional functions in the operative sphere. And in connection with the reorganization stages in the National Police of Ukraine, there is an urgent need to clarify and summarize the investigator’s functions according to the new legislative changes in the country. Therefore, the author defines the unified functions of the officers of the pretrial investigation bodies, taking into account the current legislation of Ukraine and the activity spheres: personal, social and activity-like. The normative legal acts are analyzed, which will determine the activity of the investigator for ensuring the groups of functions. Having studied the interpretation of the term function, it is determined that it is realized by performing duties at certain areas of work. Adapting this definition for the investigators, it focuses specifically on the duties of the officer of the pretrial investigation body under executing service instructions according to a round of duties. It is proposed to define the areas of activity of functions to be classified into three areas (personal, social and activity-like) and five groups, which in its turn are divided into specific subgroups: epistemological (analytical, evaluative, creative), operational (executive, communicative, search, investigative, verificatory, pedagogical), strategic and tactical (diagnostic, prognostic, reflective, technological), managerial (organizational, distributive, controlling, regulatory, coordination), prophylactic (preventive, protective). It is proved that all groups and their subgroups are interconnected and interdependent and only in a single complex determine the unified system of professional activity of investigative bodies of the pre-trial investigation.uk_UA
