dc.description.abstractThe armed aggression of the Russian Federation and its full-scale invasion of the territory of Ukraine forced the entire state apparatus and society as a whole to switch to operational functioning under the legal regime of martial law. According to the Basic Law, in the conditions of a state of emergency, the constitutional right guaranteed by Art. 33 of the Basic Law of Ukraine, namely freedom of movement, free choice of place of residence, right to freely leave the territory of Ukraine. Local executive authorities and local self-government bodies establish a special regime for citizens and vehicles to enter and leave the quarantine territory, and, if necessary, ensure a sanitary inspection of things, luggage, vehicles and cargo under quarantine conditions. Article 64 of the Constitution of Ukraine establishes exceptions under which individual restrictions on human rights and freedoms may be established. The introduction of martial law or a state of emergency directly acts as such a reason. According to the current legislation, during the period of martial law, the constitutional human rights and freedoms of citizens and citizens, which are provided for in Articles 30, 32, 33, 34, 38, 39, 41, 42, 43, 44, 53 of the Constitution of Ukraine, may be limited. Збройна агресія російської федерації і її повномасштабне вторгнення на територію України змусили весь державний апарат і суспільство в цілому перейти до оперативного функціонування в умовах правового режиму воєнного стану. Згідно Основного Закону, в умовах надзвичайного стану може бути обмежене конституційне право, гарантоване ст. 33 Основного закону України, а саме свобода пересування, вільний вибір місця проживання, право вільно залишати територію України. Місцеві органи виконавчої влади та органи місцевого самоврядування встановлюють особливий режим в’їзду на територію карантину та виїзду з неї громадян і транспортних засобів, а в разі потреби забезпечують проведення санітарного огляду речей, багажу, транспортних засобів та вантажів в умовах карантину. Стаття 64 Конституції України встановлює виключення, за яких можуть встановлюватися окремі обмеження прав і свобод людини. Такою підставою безпосередньо виступає впровадження воєнного або надзвичайного стану. Відповідно до чинного законодавства на період дії правового режиму воєнного стану конституційні права людини і свободи громадянина і громадянина, які передбачені статтями 30, 32, 33, 34, 38, 39, 41, 42, 43, 44, 53 Конституції України можуть бути обмежені.uk_UA
