dc.description.abstractУ статті встановлено, що договірні відносини є однією з вагомих рушійних сил цивільного обороту, оскільки опосередковують переміщення низки благ немайнового та майнового характеру в межах цивільного та господарського обороту. На підставі дослідження статистичних даних встановлено, що цивільно-правовий договір разом із трудовим створює умови для розвитку економічних процесів у кількісній та якісній складових завдяки залученню в якості засобу до переміщення матеріальних та нематеріальних благ у цивільному та господарському обороті. Разом з тим, цивільно-правовий договір завдяки широкій варіативності та безпосередньому залученню до тих чи інших економічних процесів створює більш вагомі передумови до прогресу у економічному просторі, що проявляється у нових видах та формах договорів цього виду. Трудовий договір у своїй складовій має на меті, перш за все з розглянутої позиції, забезпечення соціальної складової у реалізації змісту права на працю через гарантування певних соціальних, у тому числі у економічному сенсі, стандартів. Тому останній здійснює вплив на економіку країни опосередковано й у доволі меншій питомій вазі на відміну від цивільно-правового. У правовій площині дослідження правової природи і області прояву договірних конструкцій у цивільно-правовій та трудовій сферах свідчать про вагомий принцип свободи договору, який з одного боку фундується в межах цивільного законодавства, а з другого боку створює передумови до реалізації іншого, більш широкого принципу свободи праці, що ґрунтується на праві особи на свободу праці як природному та невід’ємному праві людини. Вказано на можливість поширення дії принципу свободи договору поряд з цивільно-правовими відносинами також і на інші суміжні відносини, перш за все трудові. The article establishes that contractual relations are one of the important driving forces of civil turnover, as they mediate the movement of a number of goods of a non-property and property nature within civil and economic turnover. Based on the study of statistical data, it was established that the civil law contract together with the labor contract creates conditions for the development of economic processes in quantitative and qualitative components due to involvement as a means of moving material and immaterial goods in civil and economic turnover. At the same time, the civil law contract, due to its wide variability and direct involvement in certain economic processes, creates more important prerequisites for progress in the economic space, which is manifested in new types and forms of contracts of this type. The labor contract in its component aims, first of all from the considered position, to ensure the social component in the implementation of the content of the right to work by guaranteeing certain social, including in the economic sense, standards. Therefore, the latter influences the economy of the country indirectly and in a rather smaller specific weight, in contrast to the civil law. In the legal sphere, research into the legal nature and the area of manifestation of contractual constructions in civil law and labor spheres testify to the weighty principle of freedom of contract, which, on the one hand, is founded within the limits of civil legislation, and on the other hand, creates prerequisites for the implementation of another, broader principle of freedom of labor , which is based on the individual's right to freedom of labor as a natural and inalienable human right. It is pointed out the possibility of extending the principle of freedom of contract along with civil law relations to other related relations, first of all labor relations.
