Право дітей на безпечне середовище в умовах воєнного стану (на прикладі російсько-української війни)

Abstract

У роботі приділено увагу актуальним проблемам захисту права дітей на безпечне середовище, порушення яких виникають в складних умовах запровадженого правового режиму воєнного стану. Розкрито в цілому зміст деяких прав дітей, які порушуються окупаційною владою на місці їх проживання та під час евакуації з оточених регіонів України. Розглянуто передумови створення протимінної небезпеки на місцевості, де велися бойові дії, проаналізовано норми міжнародного гуманітарного права та чинного законодавства України, які гарантують належні умови життя цій категорії населення.

The work pays attention to the current problems of protecting children's right to a safe environment, violations of which occur in the difficult conditions of the introduced legal regime of martial law. The content of some children's rights, which are violated by the occupation authorities at their place of residence and during evacuation from the surrounded regions of Ukraine, is revealed in general. The prerequisites for the creation of anti-mine hazards in the area where hostilities were conducted were considered, the norms of international humanitarian law and the current legislation of Ukraine, which guarantee proper living conditions for this category of the population, were analyzed.
