Вплив інтернету на права дітей протягом збройного конфлікту - зарубіжний досвід

Abstract

Збройні конфлікти додають свого негативного внеску в усі сфери життя потурбованих держав. Зокрема підсилюється злочинне застосування Інтернету проти прав дітей. Не тільки виникають новій, специфічні для бойових дій комп’ютерні злочини, але також отримують додаткового розвитку злочини, що існували до конфлікту. Хоча в Україні, нажаль, накопичено власний досвід щодо зазначених злочинів і боротьби з ними, доцільно звернутися до і міжнародного досвіду, накопиченого протягом усього часу існування Інтернету. У наданому розділі розглянуто прийоми злочинців щодо вчинення тих злочинів проти прав дітей за допомогою Інтернету, що пов’язані безпосередньо зі збройними конфліктом: вербування, радикалізація, пропаганда, маніпуляції та примус, дезінформація. Розглянуто також, як протягом збройного конфлікту Інтернет застосовується для розвитку злочинів, що існували до збройного конфлікту: торгівля людьми, онлайн-експлуатація, кібербулінг та кіберагресія. Приділено уваги основним напрямам боротьби з порушеннями прав дітей під час збройного конфлікту, обумовленими неправомірним застосуванням Інтернету, а також відповідній діяльності міжнародних організацій. Розділ завершує розгляд напрямів застосування Інтернету для захисту та відновлення прав дітей протягом збройного конфлікту.

Armed conflicts add their negative contribution to all spheres of life of the troubled states. In particular, the criminal use of the Internet against children's rights is increasing. Not only are new war-specific computer crimes emerging, but crimes that existed before the conflict are also gaining additional development. Although Ukraine, unfortunately, has accumulated its own experience with regard to the mentioned crimes and combating them, it is advisable to turn to the international experience accumulated during the entire existence of the Internet. This section examines the methods used by criminals to commit those crimes against children's rights via the Internet that are directly related to armed conflict: recruitment, radicalization, propaganda, manipulation and coercion, disinformation. It is also considered how during the armed conflict the Internet is used for the development of crimes that existed before the armed conflict: human trafficking, online exploitation, cyberbullying and cyber aggression. Attention is paid to the main directions of combating violations of children's rights during the armed conflict caused by the illegal use of the Internet, as well as the relevant activities of international organizations. The chapter concludes with consideration of the areas of application of the Internet for the protection and restoration of children's rights during armed conflict.
