Застосування поліцейських заходів примусу та вогнепальної зброї під час воєнного стану

Abstract

Стаття присвячена питанню нормативно-правового регулювання застосування поліцейських заходів примусу та вогнепальної зброї під час воєнного стану. Автором наголошено, що в ході інтеграції України до Європейського Союзу, важливого значення набуває прийняття ефективного законодавства, яке регулює питання діяльності Національної поліції взагалі, та під час дії воєнного стану зокрема. Наголошено на тому, що надаючи право поліцейському застосовувати підручні засоби, законодавець повинен був дати визначення та класифікацію таких засобів. Здійснений аналіз міжнародно-правових актів стосовно термінології при поводжені з вогнепальною зброєю, зроблений висновок про те, що у проаналізований зарубіжних актах, стосовно вогнепальної зброї використовується один термін – «застосування зброї».

The article is devoted to the topical issue of legal regulation of the use of coercive police measures and firearms during martial law. The author emphasized that in the course of Ukraine's integration into the European Union, the adoption of ef-fective legislation that regulates the activities of the National Police in general, and during martial law in particular, becomes important. Attention is focused on the fact that the timely introduction of changes to legislative acts becomes important pre-cisely during the martial law, which enables police units to act in accordance with the circumstances arising in their professional activities. The author states that the amendment to the Law of Ukraine "On the National Police" is the introduction of such a concept as a police measure, which is an action or a set of ac tions of a preventive or coercive nature that restricts certain rights and freedoms of a person and is used by the police in accordance with the law to ensure the fulfillment of tasks entrusted to the police powers. The author emphasized the fact that the police action must be legal, necessary, proportionate and effective. It has been established that the most severe coercive measure is the use of firearms, in connection with which it is extremely important for police officers to comply with the requirements of the law in order to prevent exceeding their pow-ers and causing harm. It is emphasized that, giving the police the right to use im-provised means, the legislator should have given the definition and classification of such means. An analysis of international legal acts related to the terminology when handling firearms was carried out, and it was concluded that in the analyzed foreign acts, one term is used in relation to firearms - "weapon use". It is proposed to use in Article 46 of the Law of Ukraine "On the National Po-lice" instead of the used terms "apply". "actively apply", "use", one term, as provided in the Laws of foreign countries, the term "Apply".
