Закриття кримінального провадження щодо злочинів проти життя та здоров’я особи: доктринальні та практичні проблеми

Abstract

У статті досліджено, головним чином крізь призму практики Європейського суду з прав людини, Конституційного Суду України та Верховного Суду особливості закриття кримінального провадження на підставі п. 10 ч. 1 ст. 284 КПК України. Розглянуто низку теоретичних та практичних аспектів застосування п. 10 ч. 1 ст. 284 КПК України в світлі позицій, викладених у постанові Об`єднаної палати Касаційного кримінального суду Верховного Суду від 13 лютого 2023 року.

The article studies, mainly through the prism of the practice of the European Court of Human Rights, the Constitutional Court of Ukraine and the Supreme Court, the peculiarities of the closure of criminal proceedings on the basis of paragraph 10 of Part 1 of Art. 284 of the Criminal Procedure Code of Ukraine. A number of theoretical and practical aspects of the application of paragraph 10 of Part 1 of Art. 284 of the criminal procedural college of Ukraine in the light of the positions set forth in the decision of the Joint Chamber of the Cassation Criminal Court of the Supreme Court of February 13, 2023.
