dc.description.abstractСтаття присвячена дослідженню співвідношення права мати захисника неповнолітнім підозрюваним, обвинуваченим з правом мати представника неповнолітнім потерпілим. Розглядаємо обов’язкове представництво неповнолітнього потерпілого, яке здійснює особа, яка може бути адвокатом, як аналог захисту, в ході якого неповнолітній потерпілий отримує кваліфіковану юридичну допомогу з боку обраного або призначеного адвоката. Запропоновано внести до КПК перелік випадків щодо забезпечення у кримінальному провадженні обов’язкової участі представника потерпілого. Пропонується, що у цих випадках, як представник потерпілого допускається адвокат, обраний потерпілим чи його законним представником. У разі, якщо адвоката не запрошено самим потерпілим або його законним представником, слідчий, прокурор виносить постанову, а слідчий суддя та суд постановляє ухвалу, якою доручає відповідному органу (установі), уповноваженому законом на надання безоплатної правової допомоги, призначити адвоката для здійснення представництва за призначенням та забезпечити його прибуття у зазначені у постанові (ухвалі) час і місце для участі у кримінальному провадженні. Запропоновано порядок дій щодо постанови (ухвали) про доручення призначити представника, визначені окремі питання оплати праці адвоката у разі відсутності у потерпілого чи його законного представника коштів. The article is devoted to the study of the relationship between the right to have a defense attorney for minor suspects, the accused and the right to have a representative for minor victims. We consider mandatory representation of a minor victim, which is carried out by a person who may be a lawyer, as an analogue of protection, during which the minor victim receives qualified legal assistance from a selected or appointed lawyer. It is proposed to add to the Code of Criminal Procedure a list of cases regarding ensuring the mandatory participation of the victim's representative in criminal proceedings. It is proposed that in these cases, a lawyer chosen by the victim or his legal representative is allowed as a representative of the victim. In the event that the lawyer is not invited by the victim himself or his legal representative, the investigator, the prosecutor issues a resolution, and the investigating judge and the court issue a resolution instructing the relevant body (institution), authorized by law to provide free legal aid, to appoint a lawyer to provide representation for appointment and ensure his arrival at the time and place specified in the resolution (resolution) to participate in criminal proceedings. The procedure for actions regarding the resolution (resolution) on the mandate to appoint a representative is proposed, and separate issues of remuneration for the lawyer's work in the event that the victim or his legal representative do not have funds are defined.
