dc.description.abstractВ статті проаналізовано забезпечення Національною поліцією прав і свобод громадян. Встановлено, що незважаючи на воєнний стан з 2022 року Україна продовжує шлях інтеграції. На шляху реформування та становлення держави України в цілому та окремих її структурних елементів особлива увага приділяється забезпеченню прав та свобод громадян. В умовах сьогодення продовжується здійснюватися судова реформа, реформування державного апарату та антикорупційних органів, направлені на безумовне дотримання принципів верховенства права, рівності конституційних прав і свобод та справедливості для всіх громадян. Сьогодні Україна, як зазначив Уповноважений з прав людини, не лише перебуває у війні та обороняє країни Євросоюзу від війни на їхній території, а й є «полігоном» для напрацювання нових правил стримування агресора, які могли б припинити геноцидні наміри і масові порушення прав людини, а також унеможливили такі випадки надалі в будьякій частині світу. Тортури, сексуальне насильство стосовно жінок, чоловіків і дітей, позасудові страти, насильницькі зникнення, депортації та примусові переміщення стали реаліями життя людей, які залишилися на територіях, окупованих РФ, без жодної змоги бути захищеними міжнародним правом [1]. Особлива роль у боротьбі з порушеннями прав та сво бод людини відводиться Національній поліції України. Визначено, що особовий склад Національної поліції, в умовах воєнного стану переведено на посилений варі ант службової діяльності, значно розширено їх повноваження які не характерні для виконання в мирний час, так вони забезпечують та здійснюють заходи правового режиму воєнного стану, а саме, щоденно безперервно реагують на заяви і повідомлення громадян, документують, розкривають та розслідують правопорушення, виявляють тіла закатованих українців, проводять ексгумацію масових поховань, фіксують пошкодження інфраструктурних об’єктів, житла, а також несуть службу на блокпостах, протидіють діяльності диверсійно-розвідувальних груп, здійснюють евакуаційні заходи, здійснюють розмінування деокупованих територій, надають психологічну підтримку людям тощо. Доведено, що забезпечення Національною поліцією прав і свобод громадян є основою виконання ними своїх функціональних обов’язків, від діяльності яких залежить думка громадян про роботу правоохоронної роботи в цілому. Взаємодія з населенням з контролю за дотриманням прав і свобод громадян, впровадження в поліцейську діяльність найкращих світових практик щодо дотримання прав і свобод громадян значно підвищить ефективність роботи всієї системи. The article analyzes the provision of the rights and freedoms of citizens by the national police. It was established that, despite the state of war, from 2022 Ukraine continues the path of integration. On the path of reforming and establishing the state of Ukraine as a whole and its individual structural elements, special attention is paid to ensuring the rights and freedoms of citizens. In today’s conditions, judicial reform, reforming of the state apparatus and anti-corruption bodies, aimed at unconditional observance of the principles of the rule of law, equality of constitutional rights and freedoms, and justice for all citizens, continue to be carried out. Today, as noted by the Commissioner for Human Rights, Ukraine is not only at war and defending the EU countries from war on their territory, but is also a “training ground” for developing new rules for deterring the aggressor, which could stop genocidal intentions and mass violations of human rights. and also made such cases impossible in the future in any part of the world. Torture, sexual violence against women, men and children, extrajudicial executions, forced disappearances, deportations and forced displacements became the realities of life for people who remained in the territories occupied by the Russian Federation, without any possibility of being protected by international law [1]. A special role in the fight against violations of human rights and freedoms is assigned to the National Police of Ukraine. It was determined that the personnel of the National Police, in the conditions of martial law, was transferred to a strengthened variant of official activity, their powers, which are not typical for execution in peacetime, were significantly expanded, so they ensure and implement the measures of the legal regime of martial law, namely, they continuously respond to statements and reports of citizens, document, reveal and investigate crimes, discover the bodies of tortured Ukrainians, exhume mass graves, carry out exhumation of mass graves, fix damage to infrastructure facilities, housing, and also serve at checkpoints, oppose the activities of sabotage and intelligence groups, carry out evacuation measures, carry out demining of de-occupied territories, provide psychological support to people, etc. It has been proven that the National Police’s provision of citizens’ rights and freedoms is the basis of their performance of their functional duties, on which the citizens’ opinion about the work of law enforcement as a whole depends. Interaction with the population to monitor the observance of the rights and freedoms of citizens, the implementation of the best global practices in the police activity regarding the observance of the rights and freedoms of citizens will significantly increase the efficiency of the entire system.
