dc.description.abstractСтаття присвячена дослідженню дисциплінарного провадження, що здійснюється стосовно працівників органів поліції. Зазначено, що фактичною підставою притягнення до дисциплінарної відповідальності працівників органів поліції виступатиме дисциплінарний проступок, а процесуальною – наказ про накладення дисциплінарного стягнення. Процедурна складова притягнення до дисциплінарної відповідальності працівників органів поліції виражається у відповідному дисциплінарному провадженні. Виокремлено спрощений та загальний порядок притягнення до дисциплінарної відповідальності поліцейських. Встановлено, що загальне дисциплінарне провадження щодо поліцейських включатиме сукупність дій, спрямованих на: прийняття рішення про порушення дисциплінарного провадження; формування дисциплінарної комісії та її склад; визначення повноважень дисциплінарної комісії; визначення основних засад роботи дисциплінарної комісії; проведення службового розслідування; формування дисциплінарної справи; прийняття рішення за результатами розгляду дисциплінарної справи. Акцентовано увагу на спеціальному дисциплінарному провадженні щодо поліцейських, проведення якого можливе внаслідок особливих умов вчинення проступку та особливих умов службового розслідування. Наприклад, йдеться про: 1) вчинення дисциплінарного проступку в період перебування у відрядженні, відпустці, на відпочинку або в період тимчасової непрацездатності; 2) вчинення дисциплінарного проступку під час чергування, несення вартової чи патрульно-постової служби; 3) вчинення дисциплінарного проступку в стані алкогольного сп’яніння. The article is devoted to the study of disciplinary proceedings carried out in relation to police officers. It is noted that the factual basis for bringing police officers to disciplinary responsibility will be a disciplinary offense, and the procedural basis will be an order to impose a disciplinary penalty. The procedural component of bringing police officers to disciplinary responsibility is expressed in the appropriate disciplinary proceedings. The simplified and general procedure for bringing policemen to disciplinary responsibility is singled out. It is established that general disciplinary proceedings against police officers will include a set of actions aimed at: making a decision to initiate disciplinary proceedings; formation of the disciplinary commission and its composition; determining the powers of the disciplinary commission; definition of the basic principles of the work of the disciplinary commission; conducting an official investigation; formation of a disciplinary case; making a decision based on the results of the disciplinary case. Attention is focused on special disciplinary proceedings against police officers, which are possible due to special conditions of committing a misdemeanor and special conditions of an official investigation. For example, it is about: 1) committing a disciplinary offense while on a business trip, on vacation, on vacation, or during a period of temporary incapacity; 2) committing a disciplinary offense while on duty, performing guard or patrol post duty; 3) committing a disciplinary offense while intoxicated. The peculiarities of disciplinary proceedings against police officers include: 1) subjects participating in the proceedings; 2) acts that formalize procedural activity and the procedure for their registration; 3) the subject of proceedings related to public relations in the sphere of performance of tasks and functions of law enforcement officials.
