КРИМІНОЛОГІЧНА ХАРАКТЕРИСТИКА ПРАВОПОРУШЕНЬ У СФЕРІ БЕЗПЕКИ ДОРОЖНЬОГО РУХУ ТА ПРОФІЛАКТИКА ТРАНСПОРТНОЇ ЗЛОЧИННОСТІ В УМОВАХ ВОЄННОГО СТАНУ

| dc.description.abstract | У роботі приділено увагу вирішенню однієї з проблем забезпечення публічної безпеки – запобіганню транспортній злочинності в умовах правового режиму воєнного стану. На основі аналізу статистичних даних патрульної поліції визначено загальний стан аварійності в Україні впродовж 2022 року, зокрема в розрізі таких аспектів, як рівні ДТП в регіонах, сталися з вини водіїв чи пішоходів, через незадовільний стан доріг та вулиць, переважних видів пригод тощо. Розкрито особливості дорожнього руху та аварійності в умовах воєнного стану: 1) зіткнення, наїзд на пішохода чи перешкоду як поширені види ДТП в цей період; 2) перевищення швидкості руху, порушення правил маневрування та порядку проїзду перехресть як основні причинами ДТП; 3) виділено регіони України з найбільшою кількістю ДТП з загиблими та/або травмованими, через незадовільний стан доріг та вулиць. Зазначено, що вчинення злочинів з необережності (транспортна злочинність) має наступні характерні відмінності: 1) не спостерігається яскраво вираженої антисоціальної спрямованості дій осіб; 2) правопорушення породжується неуважністю водія, що спричинює прийняття ним помилкового рішення та подальшого вчинення ДТП (створення аварійної ситуації, нанесення матеріальних збитків тощо); 3) у більшості випадків механізм необережної поведінки згорнутий, іноді – імпульсивний. Залежно від виду необережності виділено два типи осіб, котрі вчиняють злочини в сфері БДР – дії особи кваліфікуються як 1) злочинна самовпевненість та 2) злочинна недбалість. За проведеною соціально-демографічною характеристикою осіб, які вчиняють злочини у сфері БДР, визначено, що більше ніж 90% випадків правопорушень вчиняється чоловіками. При цьому впродовж останнього часу спостерігається підвищення питомої ваги жінок-правопорушниць; тяжкі наслідки від вчинення жінками злочинів є значно меншими. За віковими параметрами переважають серед правопорушників особи від 20 до 40 років; особливе занепокоєння викликає криміногенна ситуація щодо загибелі в ДТП дітей віком до 18 років, а також ДТП з їх вини. Розглянуто сприятливі умови для вчинення необережних злочинів проти БДР та експлуатації транспорту, визначено заходи з їх профілактики для комплексного впливу на елементи системи «людина-дорога-транспорт». The work focuses on solving one of the problems of ensuring public safety – preventing traffic crime in the conditions of the legal regime of martial law. Based on the analysis of statistical data of the patrol police, the general state of accidents in Ukraine during 2022 was determined, in particular, in terms of such aspects as the level of road accidents in the regions, due to the fault of drivers or pedestrians, due to the unsatisfactory condition of roads and streets, types of accidents, etc. The peculiarities of road traffic and accidents in the conditions of martial law are revealed: 1) collision, hitting a pedestrian or an obstacle as common types of road accidents during this period; 2) speeding, violation of the rules of maneuvering and the order of crossing the intersection as the main causes of road accidents; 3) the regions of Ukraine with the largest number of road accidents with fatalities and/or injuries due to the unsatisfactory condition of roads and streets are highlighted. It is noted that the commission of crimes due to carelessness (traffic crime) has the following characteristic differences: 1) there is no pronounced antisocial orientation of individuals’ actions; 2) the offense is caused by the driver's inattention, which causes making a wrong decision and subsequently commit a road accidents by him (creating an emergency situation, causing material damage, etc.); 3) in most cases, the mechanism of careless behavior is curtailed, sometimes impulsive. Depending on the type of carelessness, two types of persons who commit crimes in the field of RS are distinguished – the actions of a person are classified as 1) criminal selfconfidence and 2) criminal negligence. According to the conducted socio-demographic characteristics of persons who commit crimes in the field of RS, it was determined that more than 90 % of cases of offenses are committed by men. At the same time, an increase in the specific weight of female offenders has recently been observed; the serious consequences of committing crimes by women are much smaller. According to the age parameters, persons from 20 to 40 years old prevail among the offenders; the criminogenic situation regarding the death of children under the age of 18 in road accidents is of particular concern, as well as road accidents caused by them. Favorable conditions for the commission of careless crimes against RS and the operation of transport have been considered, measures for their prevention have been determined for a comprehensive impact on the elements of the «people-road-transport» system. | |
