Доктринальні основи адміністративно-правового захисту прав військовослужбовців

Abstract

У монографії досліджено концептуальні засади адміністративно-правового забезпечення прав військовослужбовців у демократичній правовій державі. Обґрунтовано дуалістичну природу правового статусу військовослужбовця як носія невідчужуваних людських прав і суб’єкта публічно-службових відносин. Здійснено доктринальне переосмислення поняття адміністративно-правового забезпечення в аксіологічному контексті, що передбачає пріоритет гідності, автономії та свободи особи. Запропоновано структурну модель системи забезпечення прав, що включає нормативну, інституційну, ідеологічну та функціональну підсистеми. Сформульовано комплексну стратегію вдосконалення механізмів правового захисту військовослужбовців з урахуванням принципів правовладдя та міжнародних стандартів.

The monograph examines the conceptual principles of administrative and legal protection of the rights of military personnel in a democratic legal state. The dualistic nature of the legal status of a military serviceman as a bearer of inalienable human rights and a subject of public-service relations is substantiated. A doctrinal reinterpretation of the concept of administrative and legal support in the axiological context, which assumes the priority of dignity, autonomy and freedom of the individual, has been carried out. A structural model of the rights enforcement system is proposed, which includes normative, institutional, ideological and functional subsystems. A comprehensive strategy for improving the mechanisms of legal protection of military personnel was formulated, taking into account the principles of the rule of law and international standards.
