Автономні системи озброєння та принцип розрізнення в міжнародному гуманітарному праві

Abstract

У статті висвітлюється проблематика застосування встановленого в міжнародному гуманітарному праві принципу розрізнення до автономних систем озброєнь. Відзначається, що автономні системи озброєнь набувають все більшого значення в міжнародних та неміжнародних збройних конфліктах, уже наявні повідомлення про вбивства ними людей. Поступ воєнної технології неможливо зупинити, проте його треба врегулювати та зробити так, щоби він відповідав приписам міжнародного гуманітарного права. У статті наголошується, що принцип розрізнення є одним із найдавніших та одним із найбільш укорінених звичаєвих принципів міжнародного гуманітарного права, що закріплений у Додаткових протоколах до Женевських конвенцій. Будь-яка система озброєння повинна відповідати цьому принципу. Серед фахівців склався консенсус, що застосування автономних систем озброєння може порушувати принцип розрізнення, було запропоновано декілька можливих поглядів на те, як принцип розрізнення має застосовуватися до автономних систем озброєння.

The article covers the issue of application of the principle of distinction established in international humanitarian law to autonomous weapons systems. It is noted that autonomous weapons systems are becoming increasingly important in international and non-international armed conflicts, and there are already reports of killings. The progress of military technology cannot be stopped, but it must be regulated and made to comply with the requirements of international humanitarian law. The article emphasizes that the principle of distinction is one of the oldest and one of the most ingrained customary principles of international humanitarian law, which is enshrined in the Additional Protocols to the Geneva Conventions. Any weapons system must comply with this principle. There was a consensus among experts that the use of autonomous weapons systems could violate the principle of distinction, and several possible views were suggested on how the principle of distinction should be applied to autonomous weapons systems.
