Окремі питання розслідування безвісного зникнення осіб за особливих обставин

Abstract

Стаття присвячена окремим питанням розслідування безвісного зникнення осіб за особливих обставин. Автори вказують на значну кількість таких осіб, що пов’язано із повномасштабним збройним конфліктом на території України. Зазначається важливість проведення ефективного розслідування та встановлення всіх обставин безвісного зникнення осіб за особливих обставин. Проаналізовані міжнародні нормативно-правові акти та вітчизняне законодавство у цій сфері. Аналіз кримінальних проваджень щодо безвісти зниклих осіб у районах збройного конфлікту дав підстави умовно поділити їх за суб’єктом на дві категорії: щодо цивільних осіб та щодо військових; за територією: безвісне зникнення на тимчасово окупованій території, у зоні активних бойових дій, на територіях, які до таких не належать. Авторами зазначається, що в залежності від характеристик суб’єкта, який зник безвісти, можуть висуватися наступні версії щодо цивільних осіб: особа перебуває у полоні (є цивільним заручником); здійснено насильницьке вивезення особи з території України; особа загинула внаслідок вчинення воєнного злочину; особа жива, однак її місцезнаходження не відомо; особа загинула внаслідок вчинення злочину, який не відноситься до категорії воєнних, однак на території, доступ до якої унеможливлено тощо. Версії щодо зникнення військовослужбовців: особа перебуває у полоні (є військово-полоненим); особа загинула внаслідок вчинення воєнного злочину; особа жива, однак її місцезнаходження не відомо; особа загинула внаслідок вчинення злочину, який не відноситься до категорії воєнних; особа загинула під час бойових дій тощо. Визначено первинні процесуальні дії за фактом звернення щодо безвісного зникнення особи за особливих обставин: допит родичів, знайомих, відібрання зразків для порівняльного дослідження, призначення ДНК-експертизи, направлення матеріалів до органу досудового розслідування за останнім місцем знаходження особи, що зникла безвісти. Акцентується увага на важливості взаємодії органів досудового розслідування з пошуковими групами, можливості отримання від них доказової інформації. Висвітлені питання електронного реєстру геномної інформації людини та Єдиного реєстру осіб, зниклих безвісти за особливих обставин.

The article is devoted to specific issues of the investigation of missing persons under special circumstances. The authors indicate a significant number of such persons, which is connected with the full-scale armed conflict on the territory of Ukraine. The importance of conducting an effective investigation and establishing all the circumstances of the disappearance of persons under special circumstances is noted. International legal acts and domestic legislation in this area are analyzed. The analysis of criminal proceedings regarding the disappearance of missing persons in the areas of armed conflict gave grounds for conditionally dividing them by subject into two categories: regarding civilians and regarding military personnel; by territory: unexplained disappearance in the temporarily occupied territory, in the zone of active hostilities, in territories that do not belong to such. The authors note that depending on the characteristics of the missing subject, the following versions may be put forward regarding civilians: the person is in captivity (is a civilian hostage); a person was forcibly removed from the territory of Ukraine; the person died as a result of committing a war crime; the person is alive, but his location is unknown; the person died as a result of the commission of a crime that does not belong to the military category, but in a territory to which access is impossible, etc. Versions regarding the disappearance of servicemen: the person is in captivity (is a prisoner of war); the person died as a result of committing a war crime; the person is alive, but his location is unknown; the person died as a result of committing a crime that does not belong to the military category; the person died during hostilities, etc. The initial procedural actions upon the fact of an application regarding the missing person’s disappearance under special circumstances are defined: questioning of relatives, acquaintances, sampling of samples for comparative research, appointment of DNA expertise, sending materials to the pre-trial investigation body at the last location of the missing person. Emphasis is placed on the importance of interaction between pre-trial investigation bodies and search groups, the possi-bility of obtaining evidentiary information from them. The issues of the electronic register of human genomic information and the Unified register of persons missing under special circumstances are covered.
