Слідова картина як елемент криміналістичної характеристики злочинів у сфері земельних відносин: особливості та шляхи виявлення

Abstract

У статті з урахуванням сучасного стану розвитку криміналістичної науки та правоохоронної практики досліджено слідову картину злочинів, які вчиняються у сфері земельних відносин, акцентовано увагу на місці слідової картини в структурі криміналістичної характеристики злочинів. Відмічено наявність обов’язкового відображення в навколишній обстановці наслідків дії злочинців у формі слідів. Зазначено про існування постійного попиту на вивчення і дослідження слідів злочину при розслідуванні будь-якого кримінального правопрушення і злочинів у сфері земельних відносин зокрема. Підкреслено фундаментальність криміналістичного вчення про сліди в науковій теорії криміналістики. Відмічено особливу значущість для Української держави і суспільства сфери земельних відносин, наявність багатьох викликів та загроз, одним із яких є земельні кримінальні правопорушення.

In the article, taking into account the current state of development of forensic science and law enforcement practice, the trace pattern of crimes committed in the field of land relations is investigated, attention is focused on the place of the trace pattern in the structure of the forensic characteristics of crimes. It is noted that there is a mandatory reflection in the surrounding environment of the consequences of the actions of criminals in the form of traces. It is noted that there is a constant demand for the study and research of traces of crime in the investigation of any criminal offense and crimes in the field of land relations in particular. The fundamentality of the forensic science of traces in the scientific theory of forensics is emphasized. The special significance of the sphere of land relations for the Ukrainian state and society, the presence of many challenges and threats, one of which is land criminal offenses, was noted. The author emphasizes that depending on the nature of the crimes committed in the field of land relations, the methods of their commission, the tools used, various traces and physical evidence remain at the scene of the incident, which in turn form a trace picture of the committed crime. Their identification, analysis, establishment of causal relationships allow to build a picture of the event, to form imaginary or actual models of the crime, the mechanism of its commission. The study of such traces and material evidence can indicate the identity of the criminal, the identity of the victim and the circumstances of the event, reveal traces of the concealment of the crime, etc.
