Адміністративно-правові засади охорони громадського порядку під час проведення масових заходів

Abstract

У дисертації розкрито адміністративно-правові засади охорони громадського порядку під час проведення масових заходів. З’ясовано, що адміністративно-правове забезпечення охорони громадського порядку під час проведення масових заходів у широкому розумінні – це засади виконання адміністративними органами своєї місії та завдань на основі норм адміністративного права, стосовно створення безпечних та належних умов для громадян України, інших фізичних та юридичних осіб реалізовувати своє право збиратися мирно, без зброї і проводити збори, мітинги, походи і демонстрації із завчасним сповіщенням відповідних органів виконавчої влади чи органу місцевого самоврядування про його проведення. У вузькому розумінні адміністративно-правове забезпечення охорони громадського порядку під час проведення масових заходів – це упорядкована система адміністративно-правових засад, способів та адміністративних процедур (проваджень), які застосовуються адміністративними та правоохоронними органами. Зазначено, що всі державні органи здійснюють забезпечення громадської безпеки, але саме на органи Національної поліції покладена важлива роль у захисті, від імені держави, прав та свобод людини і громадянина, сприянню проведення мирних заходів, дозволяючи вільно висловлювати свої думки та почуття в межах дозволеного законодавством.

The dissertation reveals the administrative and legal principles of public order protection during mass events. It is found that administrative and legal support for the protection of public order during mass events in a broad sense is the principles of fulfillment by administrative bodies of their mission and tasks on the basis of administrative law, to create safe and appropriate conditions for citizens of Ukraine, other individuals and legal entities to exercise their right to assemble peacefully, unarmed and hold meetings, rallies, marches and demonstrations with advance notification of the relevant executive authorities or local self-government bodies about the event. In a narrow sense, administrative and legal support for the protection of public order during mass events is an orderly system of administrative and legal principles, methods and administrative procedures (implementations), which are applied by administrative and law enforcement authorities. It is noted that all state bodies ensure public security, but it is the National Police that has an important role in protecting, on behalf of the state, the rights and freedoms of man and citizen, promoting peaceful events, allowing people to freely express their thoughts and feelings within the limits permitted by law. The scientific aspects of the philosophical and legal foundations of the institution of public order as the basis of a stable and just society, which is ensured through legislation, moral norms and police activities, when the state must protect the rights and freedoms of citizens, maintaining order and security through coercion, if necessary, are investigated. From the perspective of the philosophy of law, public order is a key element in the functioning of the state, society, and law. It ensures stability, security of citizens, and the proper functioning of social institutions. Public order is based not only on legislation, but also on moral norms and legal institutions that affirm the rights and freedoms of citizens.
