Проходження служби в Національній поліції під час воєнного стану

Abstract

Стаття присвячена дослідженню ключових аспектів проходження служби в Національної поліції в умовах воєнного стану. Стаття має аналітично-описовий характер і покликана виокремити конкретні правові норми, що стосуються проходження поліцейськими служби під час дії воєнного стану в Україні. Законодавство включає в себе положення, що визначаються нормативно-правовими актами різної юридичної сили. Втім, переважна більшість таких норм міститься в законі України «Про Національну поліцію», але в різних статтях, що ускладнює їх виокремлення та які через це потребують упорядкування. Автори статі фокусуються на аналізі та описі конкретних положень законодавства без широкого теоретичного та дослідницького підґрунтя, оскільки мета статті – надати чітку та доступну інформацію про конкретні норми законодавства, які регулюють питання проходження служби в Національній поліції під час запровадження воєнного стану. Варто зазначити, що в статті виокремлюються не особливості здійснення поліцейської діяльності під час воєнного стану, а саме питання, що стосуються процесу несення служби, зокрема щодо організації графіку роботи, умов виконання службових обов’язків, переміщення по служб та інші аспекти, пов’язані з професійною діяльністю поліцейських в умовах воєнного стану. Стаття надає розуміння відмінностей організації роботи поліцейських в мирний час та в умовах воєнного стану, оскільки увага акцентується саме тих аспектах несення служби, що притаманні воєнному часі і не застосовуються в інший час. Маючи описовий характер, наукова стаття може стати підґрунтям для подальших наукових розвідок в цій тематиці, оскільки допомагає визначити нові напрямки або поглибити розуміння вже існуючих проблем та тем.

The article is devoted to the study of key aspects of serving in the National Police under martial law. The article has an analytical-descriptive nature and is designed to highlight specific legal norms related to police service during martial law in Ukraine. Legislation includes provisions determined by normative legal acts of different legal force. However, the vast majority of such norms are contained in the Law of Ukraine "On the National Police", but in different articles, which makes it difficult to distinguish them and which therefore require streamlining. The authors of the article focus on the analysis and description of specific provisions of the law without a broad theoretical and research basis, since the purpose of the article is to provide clear and accessible information about the specific laws governing the issue of serving in the National Police during the introduction of martial law. It is worth noting that the article does not single out the specifics of police activity during martial law, but specifically issues related to the process of service, in particular, regarding the organization of the work schedule, conditions for the performance of official duties, transfer between services and other aspects related to with the professional activities of police officers under martial law. The article provides an understanding of the differences in the organization of police work in peacetime and in wartime conditions, as attention is focused on those aspects of service that are inherent in wartime and are not used in other times. Being descriptive in nature, a scientific article can become the basis for further scientific research in this topic, as it helps to define new directions or deepen the understanding of already existing problems and topics.
