Доступ до правосуддя в Україні: історико-правове дослідження

Abstract

Дисертацію присвячено комплексному історико-правовому аналізу концептуальних засад становлення і розвитку доступу до правосуддя в Україні в різні історичні періоди та рецепції його ключових положень у сучасних умовах вітчизняного державо- і правотворення. Аналіз історико-теоретичних та філософських передумов доступу до правосуддя свідчить про таке. Пов’язуючи правосуддя з такими поняттями, як мистецтво, краса, суспільне благо, держава, політика, а також із ідеями божественного походження правосуддя, правди, справедливості, народного правосуддя, досягнення суспільної гармонії шляхом урівноваження протилежних інтересів, античні й давньосхідні мислителі створили ідейні підвалини для всебічного, насамперед філософського, осмислення природи правосуддя. The dissertation is devoted to a comprehensive historical and legal analysis of the conceptual foundations of the formation and development of access to justice in Ukraine in different historical periods and the reception of its key provisions in the current conditions of national state and law-making. The analysis of the historical, theoretical and philosophical prerequisites for access to justice shows the following. By associating justice with such concepts as art, beauty, public good, state, politics, as well as with the ideas of the divine origin of justice, truth, achieving social harmony by balancing opposing interests, ancient and ancient Eastern thinkers created the ideological foundations for a comprehensive, primarily philosophical, understanding of the nature of justice.
