Нормативно-правове регулювання взаємодії суб’єктів забезпечення національної безпеки України

Abstract

У статті досліджено нормативно-правове забезпечення взаємодії суб’єктів забезпечення національної безпеки України. Наголошено, що ефективне функціонування сектору безпеки і оборони в умовах сучасних загроз потребує чіткої координації між усіма залученими органами, що можливо лише за наявності узгодженої нормативної основи. Здійснено структуризацію правового регулювання взаємодії на чотири рівні: ідеологічно-нормативний, інституційно-нормативний, програмно-стратегічний та операційно-регламентаційний. Ідеологічно-нормативний рівень формує ціннісні та концептуальні засади безпеки (Конституція України), інституційно-нормативний – окреслює правовий статус, повноваження та зобов’язання суб’єктів взаємодії (закони «Про національну безпеку України», «Про оборону України», «Про Про Раду національної безпеки і оборони України» тощо), програмно-стратегічний – визначає стратегічні пріоритети та механізми координації (зокрема, Стратегія національної безпеки України), а операційно-регламентаційний – містить відомчі нормативні акти, що встановлюють конкретні процедури взаємодії. Окрему увагу приділено ролі таких органів, як прокуратура та Державне бюро розслідувань, які не входять до складу сектору безпеки, але виконують функції у сфері національної безпеки у тісній взаємодії з основними суб’єктами. Зроблено висновок про фрагментарність чинної нормативної бази, що ускладнює координацію дій у кризових ситуаціях, та обґрунтовано доцільність систематизації джерел права, що регламентують взаємодію у цій сфері.

The article examines the regulatory and legal support for the interaction of subjects of ensuring the national security of Ukraine. It is emphasized that the effective functioning of the security and defense sector in the conditions of modern threats requires clear coordination between all involved bodies, which is possible only with the presence of an agreed regulatory framework. The legal regulation of interaction is structured into four levels: ideological and normative, institutional and normative, programmatic and strategic, and operational and regulatory. The ideological and normative level forms the value and conceptual principles of security (the Constitution of Ukraine), the institutional and normative level outlines the legal status, powers and obligations of the subjects of interaction (the laws “On National Security of Ukraine”, “On Defense of Ukraine”, “On the National Security and Defense Council of Ukraine”, etc.), the programmatic and strategic level defines strategic priorities and coordination mechanisms (in particular, the National Security Strategy of Ukraine), and the operational and regulatory level contains departmental regulations that establish specific interaction procedures. Special attention is paid to the role of such bodies as the Prosecutor’s Office and the State Bureau of Investigation, which are not part of the security sector, but perform functions in the field of national security in close cooperation with the main subjects. The conclusion is made about the fragmentation of the current regulatory framework, which complicates the coordination of actions in crisis situations, and the expediency of systematizing the sources of law that regulate interaction in this area is substantiated.
