Множинне громадянство в констуційно-правовому вимірі: виклики глобалізації та захист національного суверенітету

Abstract

Стаття присвячена дослідженню проблеми множинного громадянства в контексті сучасних викликів глобалізації. Особлива увага приділяється аналізу конституційно-правових аспектів множинного громадянства та його впливу на національний суверенітет. Розглянуто правові основи, на які спираються держави в питаннях регулювання громадянства, а також виклики, з якими стикаються країни, що визнають множинне громадянство. Окремо розглянуто новітні зміни в українському законодавстві, пов’язані із цією темою, і можливі наслідки для національного суверенітету.

The article is devoted to a comprehensive study of the issue of multiple citizenship in the context of contemporary globalization processes, which present new challenges for states around the world, particularly Ukraine. Multiple citizenship is an important legal category that affects not only individual rights but also the principles of public administration and national security. The author analyzes the constitutional and legal aspects of multiple citizenship, focusing on the interconnection between citizens’ rights and the challenges arising from the existence of dual or multiple citizenships. The article provides a detailed analysis of how different countries approach the regulation of this issue, particularly through national laws, international agreements, and constitutional norms. The author compares the approaches of various states to the recognition of multiple citizenship and examines the potential problems arising from such approaches, especially in relation to national security and state sovereignty. One of the key aspects is how multiple citizenship can impact the state’s ability to control its citizens and maintain the stability of legal norms in the event of conflicts between the rights of different states.
