Рівень довіри населення до поліції: чи об'єктивний критерій оцінки ефективності діяльності поліції?

Abstract

Стаття присвячена дослідженню адміністративно-правових аспектів окремих проблемних питань об'єктивності основного критерій оцінки ефективності діяльності органів і підрозділів поліції - рівня довіри населення до поліції. Автор дійшов до висновку, що рівень довіри населення до Національної поліції має бути допоміжним критерієм як по відношенню до конкретного поліцейського, так й до органу та підрозділу поліції в цілому та мас прикладний характер до оцінки, яке дає керівництво поліції. При цьому треба враховувати, що оцінка рівня довіри населення може суттєво відрізнятися від дійсного рівня довіри внаслідок рівня правосвідомості, законослухняності опитаних, рівня сприймання поліції внаслідок стереотипів, закладених у свідомість особи через ЗМІ, інтернет, а також помилок (викривлень) результатів опитувань. Стверджується, що визначення у ч. З cm. 11 Закону України «Про Національну поліцію», що рівень довіри населення до поліції є основним критерієм оцінки ефективності діяльності органів і підрозділів поліції не в повній мірі відповідає сутності діяльності Національної поліції, не націлює поліцейських всіх рівнів на якість виконання саме завдань та функцій поліції Внаслідок цього поліція націлена до отримання довіри від населення, а не на належне виконання своїх завдань та функцій. При цьому довіру окремих представників населення можна отримати шляхом бездіяіьності або порушення законодавства з боку поліції Наголошується, що рівень довіри населення до поліції с додатковим критерієм оцінки ефективності діяльності органів і підрозділів, яка випливає саме з якісного виконання завдань та функцій поліції. Пропонується у Законі України «Про Національну поліцію» визначити, що основним критерієм оцінки ефективності діяльності поліцейських, органів і підрозділів поліції с повнота, якість виконання завдань поліції, визначених у cm. 2 вказаного Закону. The article is devoted to the study o f administrative and legal aspects o f certain problematic issues o f the objectivity o f the main criterion for evaluating the effectiveness o f police bodies and units - the level o f public trust in the police. The author came to the conclusion that the level o f public trust in the National Police should be an auxiliary criterion both in relation to a specific police officer and to the police body and unit as a whole and has an applied nature to the assessment given by the police leadership. At the same time, it should be taken into account that the assessment o f the level o f trust o f the population may differ significantly from the actual level o f trust due to the level o f legal awareness, law-abidingness o f the respondents, the level o f perception o f the police due to stereotypes planted in the mind o f a person through the media, the Internet, as well as errors (distortions) o f survey results. It is claimed that the definition in Part J o f Art. II o f the Law of Ukraine "On the National Police", which states that the level o f public trust in the police is the main criterion for evaluating the effectiveness o f police bodies and units, does not fully correspond to the essence o f the National Police, docs not target policemen o f all levels to the quality o f the performance o f police tasks and functions. As a result, the police is aimed at gaining the trust o f the population, and not at the proper performance o f its tasks and functions. At the same time, the trust o f individual representatives o f the population can be obtained through inaction or violation of the law on the part o f the police. It is emphasized that the level o f trust o f the population in the police is an additional criterion for evaluating the effectiveness o f the activities o f bodies and units, which results precisely from the high-quality performance o f tasks and functions o f the police. It is proposed to define in the Law o f Ukraine "On die National Police" that the main criterion for evaluating the effectiveness o f the activities of police officers, police bodies and units is the completeness and quality of the performance o f police tasks defined in Art. 2 o f the specified Law.
