Актуальні питання запобігання крадіжкам в умовах воєнного стану в Україні

Abstract

У статті здійснено дослідження проблемних аспектів запобігання крадіжкам. Зауважено, що крадіжка – це кримінальне правопорушення, яке характеризується, як таємне викрадення майна пов’язане із незаконним оберненням чужого майна на користь винного або інших осіб, за ступенем суспільної небезпеки та шкідливості є менш небезпечним діянням, ніж розбій і грабіж, а з точки зору кримінології складає значний відсоток від загальних показників злочинності та має вплив на її структуру. Підкреслено, що запобігання злочинності – це комплексна система дій державних органів та елементів громадянського суспільства, яка ґрунтується на внутрішньо-зовнішній діяльності держави і політиці превенції та спрямована на запобігання злочинності та використовує спеціально-кримінологічні заходи відвернення та/або припинення кримінальних правопорушень. Визначено, що запобігання крадіжкам має форму загально-соціального і спеціально-кримінологічного запобігання, які ґрунтуються на загальних і індивідуальних мірах. Зазначено, що запобігання крадіжкам реалізовується шляхом застосування інформаційно-аналітичних, організаційних заходів та заходів, що впливають на криміногенні фактори. Вказано, що основою інформаційно-аналітичних заходів запобігання крадіжок є результати кримінологічних і соціологічних досліджень та інших джерел інформації, статистичні дані узагальнення яких сприяє не тільки визначенню стану злочинності, але й дослідженню питання ефективності застосування заходів запобігання крадіжкам. Акцентовано увагу на тому, що застосування організаційних заходів та заходів, що впливають на криміногенні фактори в залежності від різновиду крадіжок та інших ключових ознак, зокрема, віктомологічних характеристик потерпілим від крадіжки осіб, осіб правопорушника, місця та умов вчинення крадіжки та ін.

It is noted that theft is a criminal offence, which is characterized as the secret theft of property associated with the illegal transfer of someone else’s property to the benefit of the guilty or other persons, in terms of the degree of public danger and harmfulness is a less dangerous act than robbery and robbery, and from the point of view from the point of view of criminology, it is a significant percentage of the total indicators of crime and has an impact on its structure. It is emphasized that the prevention of crime is a complex system of actions of state bodies and elements of civil society, which is based on the internal and external activities of the state and prevention policy and is aimed at preventing crime and uses special criminological measures to prevent and/or stop criminal offenses. It was determined that theft prevention has the form of general social and special criminological prevention, which are based on general and individual measures. It is noted that theft prevention is implemented through the use of informational and analytical, organizational measures and measures affecting criminogenic factors. It is indicated that the basis of informational and analytical measures to prevent theft are the results of criminological and sociological studies and other sources of information, the statistical data of which generalization contributes not only to the determination of the state of crime, but also to the study of the effectiveness of the application of measures to prevent theft. Emphasis is placed on the fact that the application of organizational measures and measures affecting criminogenic factors depending on the type of theft and other key features, in particular, the victimological characteristics of the victims of theft, persons of the offender, the place and conditions of the theft, etc.
