Роль судово-медичної діяльності у забезпеченні ефективної ідентифікації, вилучення та репатріації тіл загиблих в умовах збройної агресії проти України

Abstract

У статті досліджено організаційно-правові та медичні аспекти забезпечення вилучення, передачі та репатріації тіл (останків) осіб, загиблих або померлих у зв'язку зі збройною агресією проти України. Акцентовано увагу на актуальності своєчасної ідентифікації загиблих, дотриманні міжнародних гуманітарних норм та захисті прав родин на інформацію й гідне поховання в умовах масштабних втрат під час бойових дій. Визначено ключову роль судовомедичної діяльності як фундаментальної ланки, що включає медико-криміналістичну оцінку тіл померлих, первинну ідентифікацію, фіксацію ознак насильницької смерті та збереження біоматеріалу для подальших досліджень. Судово-медична експертиза трактується як науково обґрунтоване дослідження об'єктів (трупів та їх частин, живих осіб, речових доказів та ін.) для встановлення причин смерті, ступеня тяжкості тілесних ушкоджень та ідентифікації осіб за дорученням уповноважених органів.

The article examines the organizational, legal and medical aspects of ensuring the recovery, transfer and repatriation of bodies (remains) of persons killed or deceased in connection with the armed aggression against Ukraine. The emphasis is on the relevance of timely identification of the deceased, compliance with international humanitarian norms and protection of the rights of families to information and a dignified burial in conditions of large-scale losses during hostilities. The key role of forensic medicine as a fundamental link is determined, which includes medical and forensic assessment of the bodies of the deceased, primary identification, recording of signs of violent death and preservation of biomaterial for further research. Forensic medical examination is interpreted as a scientifically substantiated study of objects (corpses and their parts, living persons, material evidence, etc.) to establish the causes of death, the severity of bodily injuries and the identification of persons on behalf of authorized bodies.
