Особливості обмеження прав людини на свободу пересування в умовах правового режиму воєнного стану

Abstract

Одним із показників рівня свободи особистості та розвитку демократії у суспільстві є забезпечення права на свободу пересування. У статті проаналізовано проблемні питання, пов’язані з обмеженням права людини на свободу пересування в умовах правового режиму воєнного стану, зокрема правові підстави його застосування та обмеження. Обґрунтовано позицію, що право людини на свободу пересування не є абсолютним та може бути обмежене лише у закріплених на законодавчому рівні випадках. Визначено перелік випадків можливого обмеження права людини на свободу пересування, об’єктів та території, де такі обмеження діють, правові підстави їх застосування, а також коло осіб, на яких поширюються дані обмеження, у тому числі під час упровадження правового режиму воєнного стану.

One of the indicators of the level of individual freedom and the development of democracy in society is ensuring the right to freedom of movement. The article analyzes the problematic issues related to the restriction of the human right to freedom of movement in the legal regime of martial law, in particular the legal grounds for its application and restrictions. can be applied. The position that the human right to freedom of movement is not absolute and can be limited only in cases enshrined in law is substantiated. The article identifies a list of cases of possible restrictions on the human right to freedom of movement, facilities and territories where such restrictions apply, the legal grounds for their application, as well as the range of persons subject to these restrictions, including during the implementation of martial law.
