Методичні рекомендації для проведення практичних занять із використанням навчального полігону «Custody Records»

Abstract

Методичні рекомендації призначені для здобувачів вищої освіти, науково-педагогічних працівників закладів вищої освіти із специфічними умовами навчання, діючих поліцейських територіальних підрозділів Національної поліції та усіх, хто цікавиться питаннями дотримання прав затриманих осіб. У сучасних умовах розвитку України відбувається постійний пошук найбільш ефективних шляхів утвердження у суспільстві цінностей демократичної та правової держави. Важливу роль у цих процесах відіграє впровадження Національною поліцією України кращих практик країн Євросоюзу. Проєкт «Custody Records» призначений для покращення стандартів захисту прав затриманих осіб, внаслідок запровадження електронної фіксації інформації про всі дії щодо осіб, які перебувають під контролем поліції з моменту фактичного затримання і поміщення до ізолятора тимчасового тримання або звільнення з-під варти, а також запровадження обов’язкового інтерв’ю (опитування) затриманої особи та поліцейського, який здійснив затримання. Сучасна система «Custody Records», яка зараз активно запроваджується по всій території України, є вкрай надважливою у поліцейській діяльності, так як завдяки їй фіксується кожен крок як поліцейського, так і затриманої особи, що в подальшому унеможливлює затриманих осіб обвинуватити поліцейських у неправдивих обвинуваченнях та запобігає поліцейських вчинити будь-які незаконні дії стосовно затриманих осіб. Присутні оглянули приміщення для інтервʼювання із затриманим, його спілкування із захисником, проведення слідчих дій, а також кімнату для перебування затриманих осіб. «Custody Records» - система електронного обліку та цілодобової фіксації усіх дій, які відбуваються у відділах та відділеннях поліції. Вона має на меті забезпечення прав затриманих осіб та й самих поліцейських. Custody Records» - це не лише про відеофіксацію всіх дій затриманого з моменту самого затримання до поміщення в ізолятор тимчасового тримання або ж звільнення з-під варти. Ця система передбачає і введення окремої посади інспектора з дотримання прав людини. Це поліцейський чи поліцейська, яка відповідає за формування інформаційної підсистеми: вносить туди всю інформацію щодо фактичного місця затримання, місця перебування особи в територіальному підрозділі поліції, та все те, що відбувається у підрозділі. «Custody Records» - одна із кращих практик країн Євросоюзу, що активно впроваджує Національна поліція України. The methodological recommendations are intended for higher education applicants, scientific and pedagogical employees of higher education institutions with specific learning conditions, active police officers of territorial units of the National Police, and everyone interested in issues of respecting the rights of detained persons. In the current conditions of Ukraine's development, there is a constant search for the most effective ways to establish the values of a democratic and legal state in society. An important role in these processes is played by the implementation of the best practices of the European Union countries by the National Police of Ukraine. The «Custody Records» project is designed to improve standards of protection of the rights of detained persons by introducing electronic recording of information about all actions taken against persons under police control from the moment of actual detention and placement in a temporary detention center or release from custody, as well as the introduction of a mandatory interview (questioning) of the detained person and the police officer who carried out the detention. The modern «Custody Records» system, which is currently being actively implemented throughout Ukraine, is extremely important in police activities, as it records every step of both the police officer and the detained person, which subsequently makes it impossible for the detained persons to accuse the police officers n false accusations and prevents police officers from committing any illegal actions against detainees. Those present inspected the premises for interviewing the detainee, his communication with the defense attorney, conducting investigative actions, as well as the room for the detention of detainees. «Custody Records» is a system of electronic accounting and round-the-clock recording of all actions that take place in police departments and divisions. It aims to ensure the rights of detained persons and the police officers themselves. "Custody Records" is not only about video recording of all actions of a detainee from the moment of detention to placement in a temporary detention center or release from custody. This system also provides for the introduction of a separate position of human rights inspector. This is a policeman or policewoman who is responsible for forming an information subsystem: entering all information about the actual place of detention, the person's location in the territorial police unit, and everything that happens in the unit. «Custody Records» is one of the best practices of the European Union countries, which is actively implemented by the National Police of Ukraine.
