О соотношении принципов дифференциации и индивидуализации уголовной ответственности и исполнения наказаний

Abstract

The article focuses at the analysis of the content of penal legislation principle, enforcement and punishment as differentiation and individualization of punishment and it is also determined its socio-legal nature and role in enforcement of criminal penalties mechanism in Ukraine. Taking into consideration that the penal system is directly related to the principles action of penal policy and criminal law, it is proved that the principle of differentiation and individualization of penalties, defined in the penal policy, law and legislation is implemented by classifying of certain groups of inmates (differentiation) and based on individual characteristics of a convicted during his/her serving a sentence (individualization).
