Судова експертиза у площині реалізації права на справедливий суд

Abstract

Стаття містить дослідження сутності судової експертизи з огляду на реалізацію права на справедливий суд у процесуальному законодавстві України через призму положень Концепції про захист прав людини і основоположних свобод, напрацювань судової практики судів України та Європейського суду з прав людини. Здійснено опрацювання предметної юрисдикції Європейського суду з прав людини з питань, пов’язаних із застосуванням нормативних приписів щодо реалізації права на справедливий суд. Встановлено сутність судової експертизи як засобу до оціночної діяльності суду в межах відповідного процесу у розрізі змісту права на справедливий суд, що містить такі складові: верховенство права, справедливість та публічність судового розгляду, відповідність суду ознакам незалежності, безсторонності, законності, дотримання принципів рівності учасників процесу, здійснення судового провадження в межах розумних часових меж. Кожна з наведених складових відображена як у судовій практиці Європейського суду з прав людини, так і в українських судових інстанціях.

The article contains a study of the essence of forensic examination in view of the implementation of the right to a fair trial in the procedural legislation of Ukraine through the prism of the provisions of the Concept on the Protection of Human Rights and Fundamental Freedoms, the development of the judicial practice of the courts of Ukraine and the European Court of Human Rights. The subject jurisdiction of the European Court of Human Rights has been worked out on issues related to the application of regulations regarding the exercise of the right to a fair trial. The essence of the forensic examination as a means of assessing the court’s activity within the relevant process in terms of the content of the right to a fair trial, which includes such components as: the rule of law, fairness and publicity of the trial, compliance of the court with the signs of independence, impartiality, legality, compliance with the principles of equality, has been established participants in the process, conducting court proceedings within reasonable time limits. Each of the above components was reflected both in the judicial practice of the European Court of Human Rights and Ukrainian courts. Forensic expertise is reflected in the context of its legal regime and the legal status of an expert in both international and domestic legislation. At the same time, the process of implementation of the first into the second became significant, as well as the issue of introducing into the national judiciary the basic principles of the use of forensic expertise, formulated in the judicial practice of the ECtHR. The position is supported, according to which the variety of expert research within the framework of the relevant court proceedings is perceived as a means to support procedural guarantees that ensure a balance of justice within the limits of the relevant judicial proceedings, as well as create conditions for a proper investigation of the relevant circumstances, which are the basis of claims and objections in within the framework of one or another material and legal dispute.
