Адміністративно-правові засади виникнення та розвитку інституту нотаріату

Abstract

Актуальність статті полягає в тому, що виникнення нотаріату бере свій початок ще з історичного періоду античності, коли тільки починав будуватися суспільний устрій, який сприяв зародженню писарів-канцеляристів, що володіли писемністю та були задіянні у переписуванні населення, майна, землі, тобто формували прибутково-витратні книги для розвитку товарно-грошових відносин і таким чином, спровокували появу спадкового і речового права. Тому, є дуже актуальним та цікавим дослідження адміністративно-правових засад зародження нотаріату і висвітлення його особливостей та розвитку в світі, як юридичного інституту, сама історія нотаріату потребує поглибленого вивчення питань більш розширеного формування виникнення і становлення інституту нотаріату. Метою статті є вивчення і аналіз історії зародження, становлення та розвитку нотаріату світу в різні історичні періоди та формування його інституту. Стаття присвячена дослідженню адміністративно-правових особливостей виникнення і розвитку інституту нотаріату та аналізу зародження нотаріальних відносин в світі. Досліджено шляхи становлення нотаріату та правового забезпечення, який залежав від вдосконалення правової системи держави. Розглянуто етапи організаційної побудови структури нотаріату його положення в ієрархії органів публічної адміністрації, яке створює умови для забезпечення спроможності органів нотаріату своїми діями породжувати, змінювати або припиняти певні право-відносини у зв’язку з вчиненням нотаріальних дій. Виокремлено, що нотаріат виник як різновид адміністративної діяльності, чиє коріння можна простежити в далекому минулому. Діяльність нотаріату має великий вплив на різні сторони суспільного життя на функціонування публічного апарату, цивільного обороту та соціально-економічних відносин, це все потребує особливого правового регулювання. Охарактеризовано історіографію нотаріату, зазначено етапи становлення та ієрархію, забезпечення і супроводження правовим підґрунтям та регулюванням для удосконалення і розвитку нотаріальної діяльності.

The relevance of the article lies in the fact that the emergence of notaries dates back to the historical period of antiquity, when the social system was just beginning to be built, which contributed to the emergence of clerks-clerks who had writing and were involved in the transcription of the population, property, land, that is, they formed income and expenditure books for the development of commodity-monetary relations and thus provoked the emergence of inheritance and property law. Therefore, it is very relevant and interesting to study the administrative and legal foundations of the emergence of notaries and highlight its features and development in the world, as a legal institution, the history of notaries itself requires an in-depth study of the issues of a more extensive formation of the emergence and formation of the institution of notaries. The purpose of the article is to study and analyze the history of the emergence, formation and development of notaries in the world in different historical periods and the formation of its institution. The article is devoted exploration the administrative-legal grounds the emergence, development institute notary and analysis of nucleation notary relations in the world. The ways of the formation of notaries and legal support, which depended on the improvement of the legal system of the state, are investigated. The stages of the organizational construction of the structure of the notary public and its position in the hierarchy of public administration bodies are considered, which creates conditions for ensuring the ability of notary bodies to generate, change or terminate certain legal relations in connection with the performance of notarial actions by their actions. It is emphasized that notaries arose as a type of administrative activity, the roots of which can be traced back to the distant past. The activities of notaries have a great influence on various aspects of social life, on the functioning of the public apparatus, civil turnover and socio-economic relations, all of which require special legal regulation. The historiography of notaries is characterized, the stages of formation and hierarchy are indicated, and the provision and support of legal foundations and regulations for the improvement and development of notarial activities are indicated.
