Деякі процесуальні особливості проведення слідчих розшукових дій в умовах воєнного стану

Abstract

Стаття присвячена дослідженню процесуальних аспектів щодо особливостей проведення слідчих розшукових дій в умовах воєнного стану. Досліджені останні зміни, яких зазнав кримінальний процесуальний кодекс України, щодо спрощення окремих слідчих розшукових дій в умова воєнного стану. Проаналізовано положення кримінального процесуального кодексу, які закріплюють порядок та особливості проведення окремих слідчих розшукових дій в умовах воєнного стану. Розглянуті процесуальні слідчі (розшукові) дії спрямовані на безпосереднє виявлення та фіксацію доказової інформації в умовах воєнного стану, що має важливе значення для встановлення обставин події кримінального правопорушення. Визначено, що такі слідчі розшукові дії, як огляд місця події, проведення обшуку або огляду житла чи іншого володіння особи без залучення понятих, проведення слідчого експерименту, пред’явлення трупа для впізнання, проведення експертизи, використання показань у доказуванні в умовах воєнного стану не можуть бути здійснені за загальними умовами визначеними кримінальним процесуальним кодексом України. Встановлено, що у відношенні до деяких слідчих розшукових дій, існує спрощена процедура, зокрема огляд місця події, проведення обшуку або огляду житла чи іншого володіння особи без залучення понятих, використання показань у доказуванні. Доведено, необхідність спрощення процедури проведення слідчих (розшукових) дій в умовах воєнного стану, по відношенню до інших слідчих розшукових дій, зокрема, проведення слідчого експерименту, пред’явлення трупа для впізнання, проведення експертизи. Зазначені слідчі розшукові дії є не менш значущими у досудовому розслідуванні, тому спрощена процедура, по відношенню до них забезпечить покращення кримінальної процесуальної діяльності; ефективність досудового розслідування, дотримання прав і свобод учасників кримінального провадження.

The article is devoted to the investigation of procedural aspects of the peculiarities of investigative investigative actions under martial law. The latest changes that the criminal procedural code of Ukraine underwent, on the simplification of certain investigative investigative actions in the conditions of martial law, were investigated. The provisions of the Criminal Procedure Code, which establish the order and features of conducting individual investigative search actions in the conditions of martial law, are analyzed. The considered procedural investigative (investigative) actions are aimed at the direct detection and fixation of evidentiary information in the conditions of martial law, which is important for establishing the circumstances of the occurrence of a criminal offense. It is determined that such investigative investigative actions as inspecting the scene of the accident, conducting a search or inspection of a person’s home or other possessions without the involvement of witnesses, conducting an investigative experiment, presenting a corpse for identification, conducting an examination, using evidence in evidence under martial law cannot be carried out under the general conditions determined by the Criminal Procedure Code of Ukraine. It is established that there is a simplified procedure in relation to some investigative investigative actions, in particular, inspection of the scene of the incident, conducting a search or inspection of a person’s home or other property without the involvement of witnesses, the use of evidence in evidence. The necessity of simplifying the procedure for conducting investigative (investigative) actions in the conditions of martial law in relation to other investigative investigative actions, in particular, conducting an investigative experiment, presenting a corpse for identification, conducting an expert examination, has been proven. The indicated investigative actions are no less significant in the pre-trial investigation, therefore, the simplified procedure, in respect of which will improve the criminal procedural activity; efficiency of pre-trial investigation, observance of rights and freedoms of participants in criminal proceedings.
