Правова визначеність статусу окремих учасників дорожнього руху в сучасному законодавстві України

Abstract

Стаття присвячена дослідженню правової визначеності статусу окремих учасників дорожнього руху, зокрема, осіб, які керують легким персональним електричним транспортним засобом, за чинним законодавством України та проєктами законодавчих актів, що мають регулювати суспільні відносини у сфері забезпечення безпеки дорожнього руху. Проаналізовано законопроєкт «Про внесення змін до Кодексу України про адміністративні правопорушення та інших законодавчих актів щодо деяких аспектів підвищення безпеки учасників дорожнього руху» № 10441 від 29 січня 2024 року, яким визначається правовий статус осіб, які керують легким персональним транспортним засобом, а саме закріплюються права та обов’язки як учасників дорожнього руху, а також вирішено питання щодо можливості притягнення зазначених осіб до адміністративної відповідальності за правопорушення у сфері забезпечення дорожнього руху. На основі проведе-ного аналізу проєкту Закону та чинного законодавства України у сфері безпеки дорожнього руху, надано пропозиції щодо змісту правового статусу осіб, які керують персональним електричним транспортним засобом.

The article is devoted to the study of the legal certainty of the status of individual road users, in particular, persons who drive a light personal electric vehicle under the legislation of Ukraine. The draft law "On Amendments to the Code of Ukraine on Administrative Offenses and Other Legislative Acts Regarding Some Aspects of Improving the Safety of Road Users" No. 10441 dated January 29, 2024, which amends Art. 14 of the Law of Ukraine "On Road Traffic" in terms of coverage of persons who drive a light personal electric vehicle as a separate new category of road users; a new article is introduced according to its content. 19-2, which enshrines at the legislative level the basic rights and obligations of persons who drive light personal electric vehicles. Amendments to the Code of Ukraine on Administrative Offenses in terms of establishing administrative responsibility for violating traffic rules on electric personal transport are also proposed. Based on the analysis of the current legislation of Ukraine in the field of ensuring road traffic safety, suggestions have been made regarding the improvement of draft legal norms regulating the establishment of rights and obligations, as well as the responsibility of persons on personal electric transport. It is proposed to determine at the legislative level the possibility of driving light personal electric vehicles for persons who have reached the age of 14. Such persons should have the right to move on bicycle paths, bicycle lanes, and in their absence – on the edge of the carriageway of the road, street or on the side of the road, and the following should be distinguished from the duties: use technically sound and properly equipped vehicles; move at a speed that does not exceed 25 km/h; not to be distracted from driving vehicles; not to transport cargo that interferes with driving; not to carry passengers (except when a place for a passenger is provided by the manufacturer); wear a fastened safety helmet while driving; to prevent cases of driving under the influence of alcohol, drugs or other intoxication or under the influence of drugs that reduce attention and reaction speed; while driving on bicycle paths, bicycle lanes, or on the edge of the carriageway of the road, street or roadside.
