Завдання поліції на воді (водної поліції)

Abstract

У центрі уваги цього дослідження знаходиться проблема визначеності завдань одного з підрозділів Національної поліції України – поліції на воді. На підставі проведеного аналізу організації та правового регулювання водної (морської) поліції в інших країнах світу здійснено систематизацію її завдань за чотирма блоками з урахуванням кореляції відповідних завдань українського законодавства. За результатами дослідження запропоновано перелік завдань української поліції на воді, який у подальшому може бути використаний для удосконалення регулювання її діяльності.

The scientific article is devoted to the tasks of one of the divisions of the National Police of Ukraine - the water police. The relevance of the study is due to the problem of the lack of regulatory and legal definition of the tasks of these police units in Ukraine. The purpose of the article is to analyze the tasks of the water police units (or their counterparts in other law enforcement agencies) and their systematization taking into account the relevance of Ukrainian legislation. The expediency of the existence of such a unit within the National Police of Ukraine has been proven. Based on the analysis of the organization and legal regulation of the water (marine) police in other countries of the world (taking into account the experience of individual federal states of Germany (Bavaria, Hamburg), Poland, Italy, Croatia, France, Sweden and Chile), its tasks were systematized into four blocks: “general police tasks”, “related tasks”, “investigative tasks”, “non-police tasks”. It was emphasized that according to the tasks that are currently correlated with national legislation, units of the Ukrainian “water police” should belong to the special police (with the functions of patrol and preventive police), whose activities are based on patrolling and protection of the sea coast, the territory of ports and water bodies. objects It has been established that the awareness of the tasks of the police on the water contributes to the construction of the optimal structure of these bodies in Ukraine, the establishment of internal and external organizational ties and the proper material and technical equipment of these units. At the end of the article, a list of the tasks of the Ukrainian water police is proposed, which can be used in the future to improve the regulation of its activities.
