Права людини як правова цінність: сучасний концепт

Abstract

У статті досліджується аксіологічний вимір прав людини як фундаментальної правової цінності, що визначає основи правового регулювання в демократичному суспільстві. Акцентовано увагу на інтегративній природі прав людини, яка поєднує моральний, правовий та політичний аспекти. Розглядається баланс між універсальністю прав людини та врахуванням культурної специфіки їх реалізації. Наголошено, що універсальність і культурна специфіка не є взаємовиключними категоріями. Їх можна поєднати через розвиток концепції загальнолюдських цінностей, які об’єднують спільні для всіх суспільств ідеї гідності, свободи та справедливості, водночас дозволяючи певну гнучкість у способах їх реалізації. Здійснено аналіз їхньої ролі в системі загальноправових цінностей, а також змістового розвитку концепції прав людини під впливом сучасних викликів, таких як цифровізація, кліматичні зміни та воєнні конфлікти. Особливу увагу приділено механізмам захисту прав людини та їх значенню для становлення демократичного суспільства. Права людини, як цінність, отримують своє вираження через ефективні механізми захисту, які включають національні та міжнародні механізми. Відзначено досвід України в забезпеченні прав людини в умовах воєнного стану. Наголошено, що права людини є фундаментальною правовою цінністю, яка визначає межі впливу держави на особу та закладає основи демократичного устрою. Їх універсальність і значення в системі загальноправових цінностей сприяють формуванню глобального правопорядку, побудованого на засадах гідності, свободи, рівності та справедливості. Резюмовано, що розвиток концепції прав людини в умовах сучасних викликів вимагає перегляду механізмів їх забезпечення й захисту. Ці виклики обумовлюють необхідність постійного вдосконалення національних і міжнародних інституцій для забезпечення ефективної реалізації прав. Український досвід у цьому контексті демонструє можливість дотримання прав людини навіть за умов надзвичайних ситуацій, що підкреслює їх значення як інтегративної цінності, здатної об’єднувати моральні, правові та політичні аспекти суспільного життя. The article explores the axiological dimension of human rights as a fundamental legal value that determines the foundations of legal regulation in a democratic society. The focus is on the integrative nature of human rights combining moral, legal and political aspects. The balance between the universality of human rights and taking into account the cultural specificity of their implementation is considered. It is emphasized that universality and cultural specificity are not mutually exclusive categories. They can be combined through the development of the universal human values concept, which unite the ideas of dignity, freedom and justice common to all societies, while allowing for some flexibility in the methods of their implementation. Their role in the system of universal legal values, as well as the substantive development of the human rights concept under the influence of modern challenges, such as digitalization, climate change and military conflicts, is analyzed. Special attention is paid to the mechanisms for protecting human rights and their significance for the formation of a democratic society. Human rights, as a value, are expressed through effective protection mechanisms including national and international mechanisms. The experience of Ukraine in ensuring human rights under martial law is noted. It is emphasized that human rights are a fundamental legal value that determines the limits of the influence of the state on the individual and lays the foundations of a democratic system. Their universality and significance in the system of general legal values contribute to the formation of a global legal order built on the principles of dignity, freedom, equality and justice. It is summarized that the development of the human rights concept under the conditions of modern challenges requires a review of the mechanisms for their provision and protection. These challenges necessitate the constant improvement of national and international institutions to ensure the effective implementation of rights. Ukrainian experience in this context demonstrates the possibility of observing human rights even under emergency situations, which emphasizes their importance as an integrative value capable of uniting moral, legal and political aspects of public life.
