Міжнародно-правові механізми компенсації шкоди жертвам війни: сучасні тенденції та перспективи для України

Abstract

У статті здійснено комплексний аналіз міжнародно-правових механізмів компенсації шкоди жертвам війни в контексті сучасної трансформації інституту міжнародної відповідальності держав. Досліджено правову природу обов’язку держави щодо відшкодування шкоди, заподіяної внаслідок порушення норм міжнародного гуманітарного права та міжнародного права прав людини, із урахуванням положень Articles on Responsibility of States for Internationally Wrongful Acts та практики міжнародних судових інституцій. Встановлено, що сучасне міжнародне право розглядає компенсацію як складову комплексного механізму правового відновлення поряд із реституцією, сатисфакцією та гарантіями неповторення.

The article provides a comprehensive analysis of international legal mechanisms for compensation of damage to victims of war in the context of the modern transformation of the institution of international responsibility of states. The legal nature of the state’s obligation to compensate for damage caused as a result of a violation of the norms of international humanitarian law and international human rights law is investigated, taking into account the provisions of the Articles on Responsibility of States for Internationally Wrongful Acts and the practice of international judicial institutions. It is established that modern international law considers compensation as a component of a comprehensive mechanism of legal restoration along with restitution, satisfaction and guarantees of non-repetition.
