Формування у засуджених до позбавлення волі потреби у праці: проблеми законодавства та правозастосування

Abstract

Ефективність системи виконання покарання, діяльності кримінально-виконавчих установ закритого типу має оцінюватися як багаторівневе, взаємообумовлююче структурне утворення, яке складається як з результатів стратегічного значення (досягнення цілей покарання), так і тактичного, – створення належних умов для досягнення цих цілей в більш оптимальний термін. А отже, що є бажаним, вже під час відбування призначеного судом покарання. Зважаючи на суттєві соціально-психологічні чинники, які значно ускладнюють виховний процес в умовах ізоляції особи від суспільства, вважаємо термін відбування засудженим покарання важливим етапом у виправленні та подальшій ресоціалізації засудженого.

The effectiveness of the system of execution of punishment, the activities of closed penal institutions should be assessed as a multilevel, mutually determining structural formation, which consists of both the results of strategic importance (achieving the goals of punishment), and tactical, – the creation of appropriate conditions for achieving these goals in a more optimal term. And therefore, what is desirable, already during the serving of the punishment imposed by the court. Given the significant socio-psychological factors that significantly complicate the educational process in conditions of isolation of a person from society, we consider the term of serving a sentence by a convict to be an important stage in the correction and further resocialization of the convict.
