Принципи професійного навчання поліцейських в Україні

Abstract

У статті наголошено, що будь-яка діяльність, в тому числі з професійного навчання поліцейських заснована на певних керівних засадах, що в літературі позначається як її принципи. Здійснено аналіз підходів учених щодо розуміння сутності та значення принципів функціонування відповідної сфери суспільних відносин. З’ясована, що не дивлячись на галузь і специфіку дослідження, науковці в цілому дотримуються однієї позиції з цього питання. Підкреслено, що з огляду на те, що професійне навчання поліцейських має безумовно відповідати його нормативно-правовим основам, принципи, на яких ґрунтуються дані суспільні відносини мають бути закріпленні в приписах чинного національного законодавства. Здійснено аналіз законодавчих приписів, в яких визначено як принципи поліцейської діяльності, так і принципи, пов’язані із реалізацією особою права на здобуття освіти. Наголошено, що професійне навчання поліцейських буде ґрунтуватися на значній кількості принципів, з урахуванням чого здійснено їх наукову класифікацію за таким критерієм як сфера їх поширення. Обґрунтовано, що в такому разі принципи професійного навчання поліцейських слід розподілити в три групи: загальні; принципи, пов’язанні із реалізацією права на здобуття освіти; спеціальні принципи. Надано авторське бачення сутності принципів професійного навчання поліцейських.

The article emphasizes that any activity, including professional training of police officers, is based on certain guiding principles, which are referred to in the literature as its principles. An analysis of the approaches of scientists to understanding the essence and meaning of the principles of functioning of the relevant sphere of social relations is carried out. It is found that, regardless of the field and specifics of the study, scientists generally adhere to the same position on this issue. It is emphasized that given that professional training of police officers must necessarily comply with its regulatory and legal foundations, the principles on which these social relations are based must be enshrined in the provisions of current national legislation. An analysis of legislative provisions is carried out, which define both the principles of police activity and the principles related to the realization by a person of the right to education. It is emphasized that the professional training of police officers will be based on a significant number of principles, taking into account which their scientific classification was carried out according to such a criterion as the scope of their distribution. It is substantiated that in this case the principles of professional training of police officers should be divided into three groups: general; principles related to the implementation of the right to education; special principles. The author's vision of the essence of the principles of professional training of police officers is given.
