Впровадження спільного навчання та тренінгів як складова взаємодії Національної поліції та Національної гвардії України

Abstract

Стаття присвячена питанню удосконалення механізму взаємодії Національної поліції із Національною гвардією України в контексті викликів, що постають перед правоохоронною системою України в умовах збройної агресії Російської Федерації. У статті висвітлено, що, виходячи із чинного законодавства, яке регламентує діяльність органів Національної поліції та Національної гвардії України, із зазначених органів Міністерства внутрішніх справ може бути сформовано правоохоронний механізм, який буде здатний ефективно виконувати покладені на нього завдання в умовах дії правового режиму воєнного стану та у постконфліктний період. Зокрема, мова йде про виконання службово-бойових завдань на прифронтових та деокупованих територіях. У статті встановлено, що профільне законодавство, а саме: закони України «Про Національну гвардію України» та «Про Національну поліцію» встановлюють для органів Національної поліції та Національної гвардії України суміжні завдання із охорони публічного порядку та безпеки, що закладає основу для ефективного розвитку взаємодії зазначених органів. У статті визначені основні форми взаємодії Національної поліції та Національної гвардії України, відповідно до чинного законодавства. Було наголошено, що чинна нормативна база, яка регламентує відносини в сфері взаємодії Національної поліції та Національної гвардії України не відповідає сучасним вимогам, оскільки була створена у довоєнний період. У статті зазначено, що наразі, через динамічність суспільних відносин у сфері забезпечення публічного порядку та безпеки, за якої органи Національної поліції та Національної гвардії України вимушені виконувати нетипові завдання в нетиповій обстановці, як форму взаємодії слід активно впроваджувати спільні навчання, тренування та обмін досвідом між зазначеними органами. Зокрема, мова повинна йти про впровадження такої взаємодії вже під час навчання у закладах вищої освіти системи МВС, оскільки це дасть змогу надавати здобувачам релевантні знання та зменшити адаптаційний період після проходження навчання. У статті було запропоновано в рамках курсів підвищення кваліфікації викладачів навчальних закладів системи МВС проводити спільні тренінги та семінари, які дадуть змогу викладацькому складу актуалізувати свої знання та вміння. The article is dedicated to the issue of improving the mechanism of interaction between the National Police and the National Guard of Ukraine in the context of the challenges faced by Ukraine’s law enforcement system amid the armed aggression of the Russian Federation. The article highlights that, based on the current legislation regulating the activities of the National Police and the National Guard of Ukraine, a law enforcement mechanism can be formed from these agencies of the Ministry of Internal Affairs, capable of effectively fulfilling its assigned tasks under the conditions of martial law and in the post-conflict period. In particular, this concerns the execution of combat missions in frontline and de-occupied territories. The article establishes that the relevant legislation, namely the Laws of Ukraine “On the National Guard of Ukraine” and “On the National Police,” assigns overlapping tasks to the National Police and the National Guard of Ukraine regarding the protection of public order and security, which forms the basis for the effective development of their interaction. The article identifies the main forms of cooperation between the National Police and the National Guard of Ukraine in accordance with current legislation. It is emphasized that the existing regulatory framework governing the interaction between the National Police and the National Guard of Ukraine does not meet modern requirements, as it was created before the war. The article states that due to the dynamic nature of social relations in the field of public order and security, where the National Police and the National Guard of Ukraine are forced to perform atypical tasks in an unusual environment, joint training, exercises, and experience exchange between these agencies should be actively implemented as a form of interaction. In particular, such cooperation should be introduced already at the stage of training in higher education institutions within the Ministry of Internal Affairs system, as this would provide students with relevant knowledge and reduce the adaptation period after completing their education. The article proposes that, within the framework of professional development courses for instructors of educational institutions in the Ministry of Internal Affairs system, joint training sessions and seminars should be conducted, allowing faculty members to update their knowledge and skills.
