Трансформація приватних відносин крізь призму публічного інтересу в умовах воєнного стану

Abstract

Тези містять дослідження сутності трансформації приватних відносин в умовах воєнного стану у площині превалювання публічних інтересів, пов’язаних із забезпеченням збереження незалежності та суверенності держави. Разом з тим, проєктується механізм правового регулювання, який міг би забезпечити належну грань, де приватні інтереси мали би можливість на задоволення з урахуванням введення певних обмежувальних конструкцій, як-то в представницьких відносин, при здійсненні права на житло, реалізації темпоральних меж змісту приватних відносин тощо. The abstracts contain research on the essence of the transformation of private relations in conditions of martial law in terms of the prevalence of public interests related to ensuring the preservation of the independence and sovereignty of the state. At the same time, a mechanism of legal regulation is proposed that could ensure an appropriate balance, where private interests could be satisfied, taking into account the introduction of certain restrictive structures, such as in representative relations, in the exercise of the right to housing, the implementation of temporal limits on the content of private relations, etc.
