Кримінально-процесуальні проблеми визначення співвідношення взаємодії та узгодженості при розслідуванні військових злочинів

Abstract

У наукових працях проблема взаємодії та узгодженості по відношенню до діяльності органів внутрішніх справ з виявлення злочинів, досліджена недостатньо. У цій роботі досліджено питання взаємодії та узгодженості діяльності органів внутрішніх справ у процесі виявлення та розкриття воєнних злочинів. Також було проведено аналіз співвідношення понять «взаємодія» та «узгодженість» у контексті діяльності правоохоронних органів. Крім того, визначено ключові відмінності між цими формами спільної роботи. У результаті дослідження визначено сутність взаємодії слідчого й оперативного працівника при виявленні та розкритті злочинів як комплекс узгоджених процесуальних й оперативно-розшукових дій, спрямованих на розкриття, розслідування і запобігання злочинам. Визначено перспективність подальшого наукового аналізу основних форм взаємодії слідчого й оперативного працівника органів внутрішніх справ у виявленні та розкритті злочинів. Для ефективної роботи органів внутрішніх справ з виявлення та розкриття воєнних злочинів необхідно чітко розуміти відмінності між «взаємодією» та «узгодженістю». У роботі виявлено основні ознаки, що дозволяють розрізнити ці форми спільної діяльності. Взаємодія слідчого та оперативного працівника при виявленні та розкритті злочинів визначається як узгоджений комплекс процесуальних та оперативно-розшукових дій, спрямованих на досягнення спільних цілей: розкриття, розслідування та запобігання злочинам. Зважаючи на отримані результати дослідження, вважаємо, що подальший розвиток його положень має бути спрямований на аналіз основних форм взаємодії слідчого й оперативного працівника органів внутрішніх справ при виявленні та розкритті воєнних злочинів.

In scientific works, the problem of interaction and coordination regarding the activities of internal affairs bodies in crime detection has been insufficiently studied. This paper explores the issues of interaction and coordination of the activities of internal affairs bodies in the process of detecting and solving war crimes. It also analyzes the correlation of the concepts of “interaction” and “coordination” in the context of law enforcement activities. Furthermore, the key differences between these forms of joint work are identified. The study defines the essence of the interaction between an investigator and an operative officer in the detection and solving of crimes as a complex of coordinated procedural and operational-search actions aimed at the detection, investigation, and prevention of crimes. The prospect of further scientific analysis of the main forms of interaction between the investigator and the operative officer of internal affairs bodies in the detection and solving of crimes is determined. For the effective work of internal affairs bodies in the detection and solving of war crimes, it is necessary to clearly understand the differences between “interaction” and “coordination.” The paper identifies the main features that allow distinguishing between these forms of joint activity. The interaction between an investigator and an operative officer in the detection and solving of crimes is defined as a coordinated complex of procedural and operational-search actions aimed at achieving common goals: detection, investigation, and prevention of crimes. Based on the obtained research results, it is believed that further development of its provisions should be aimed at analyzing the main forms of interaction between the investigator and the operative officer of internal affairs bodies in the detection and solving of war crimes.
