Відповідальність держав за порушення МГП при застосуванні автономних систем озброєнь

Abstract

Стаття присвячена аналізу актуальної проблеми відповідальності держав за порушення міжнародного гуманітарного права при застосуванні автономних систем озброєнь. Такі системи дедалі ширше використовуються в збройних конфліктах. В збройному конфлікті, в який втягнута Україна, вже застосовуються безпілотні літальні апарати, що розглядаються як «передтехнологія» автономних систем, і питання появи в цьому конфлікті повністю автономних систем озброєнь – це питання найближчого майбутнього. За відсутності спеціальних домовленостей про врегулювання правового статусу і особливостей застосування АСО в збройних конфліктах, слід виходити з тих можливостей, що відкриває чинне міжнародне гуманітарне право. Виникає необхідність дослідити такі можливості зокрема в аспекті відповідальності держав за порушенням міжнародного гуманітарного права при застосуванні АСО. Наведені міркування обумовлюють актуальність обраної теми дослідження.

The article analyzes the problem of responsibility of states for violations of international humanitarian law in the use of autonomous weapons systems. Such systems are increasingly used in armed conflicts. The armed conflict in which Ukraine is involved already uses unmanned aerial vehicles, which are considered "pre-technology" of autonomous systems, and the question of the emergence of fully autonomous weapons systems in this conflict is a matter of the near future. In the absence of special agreements on the settlement of the legal status and peculiarities of the use of the ASO in armed conflict, it is necessary to proceed from the possibilities offered by the current international humanitarian law. There is a need to explore such possibilities, in particular in the aspect of the responsibility of states for violations of international humanitarian law in the application of ASO. These considerations determine the relevance of the chosen research topic.
