Modern Trends in Legal Translation

Abstract

The article is devoted to modern trends and features of translation activities in the field of law. The transformation of the conditions of translation practice in the context of digitalization, active use of Internet resources, memory systems and machine translation is analyzed. Special attention is paid to such new forms as audio description, transcreation and localization, which are becoming increasingly popular in the professional environment. The concept of transcreation as a strategy for adapting a text taking into account the cultural and emotional characteristics of the target audience is highlighted, which is important in the translation of legal, commercial and media materials. The specifics of legal translation are considered, which involve not only language proficiency, but also an understanding of legal systems, terminology, document context and international standards. The importance of careful transmission of content even in small elements (headings, notes, seals) is discussed, which has a direct impact on legal accuracy. Particular attention is paid to the difficulties of translating specific terms of legal English (for example, "object sustained", "hearsay") and the need to take into account language reforms in the field of legalese, in particular the transition to plain English in the UK, USA and Australia. Audio description as a type of translation is also analyzed, which is very important in legal proceedings involving people with visual impairments. A set of requirements for a specialist is covered: observation, speech accuracy, the ability to briefly convey the essence of events. Issues of the translator's competence in the field of law are raised, in particular the need for legal education, experience, contextual thinking and continuous professional development. Attention is drawn to the challenges that arise when transferring concepts from one legal system to another, as well as to the phenomenon of linguistic simplification (including digital encryption of words in some cultures, for example in China). As a result, it is noted that language dynamics requires constant updating of approaches to translation and the formation of an appropriate strategy in intercultural communication. Статтю присвячено сучасним тенденціям та особливостям перекладацької діяльності у сфері права. Аналізується трансформація умов перекладацької практики в умовах цифровізації, активного використання інтернет-ресурсів, систем пам’яті перекладу та машинного перекладу. Окрему увагу приділено таким новітнім формам, як аудіоопис, транскреація та локалізація, що стають дедалі популярнішими у професійному середовищі. Висвітлюється поняття транскреації як стратегії адаптації тексту з урахуванням культурних та емоційних особливостей цільової аудиторії, що є важливим у перекладі юридичних, комерційних та медійних матеріалів. Розглядається специфіка юридичного перекладу, що передбачає не лише володіння мовою, а й глибоке розуміння правових систем, термінології, контексту документів та міжнародних стандартів. Обговорюється важливість ретельної передачі змісту навіть у дрібних елементах (заголовках, нотатках, печатках), що безпосередньо впливає на юридичну точність. Особлива увага звертається на труднощі перекладу специфічних термінів правової англійської (наприклад, "objection sustained", "hearsay") та на необхідність врахування мовних реформ у сфері legalese, зокрема переходу до plain English у Великій Британії, США та Австралії. Також аналізується аудіоопис як вид перекладу, що є надзвичайно важливим у судовому процесі за участю людей з порушеннями зору. Висвітлюється комплекс вимог до фахівця: спостережливість, мовна точність, уміння стисло передавати суть подій. Порушуються питання компетентності перекладача у сфері права, зокрема необхідність юридичної освіти, досвіду, контекстуального мислення та безперервного професійного розвитку. Звертається увага на виклики, що виникають при передачі понять з однієї правової системи до іншої, а також на явище мовного спрощення (включно з цифровим шифруванням слів у деяких культурах, наприклад у Китаї). У підсумку зазначається, що мовна динаміка потребує постійного оновлення підходів до перекладу та формування відповідної стратегії у міжкультурній комунікації.
