Забезпечення виборчого права як ключового складника розвитку безпосередньої демократії в Україні

Abstract

У статті висвітлюються правові аспекти реалізації виборчого права як важливого елементу розвитку безпосередньої демократії в Україні. Підкреслюється, що вибори є конституційно визначеним механізмом для формування та перевірки рівня довіри між суспільством і державними інституціями, котрі своєю чергою вони виступають основоположним принципом функціонування демократичної та правової держави, а також невід’ємною складовою її конституційного ладу. Звертається увага на ключові риси виборчого права, які мають вагоме значення для розуміння осо-бливостей організації виборчого процесу в умовах сучасного етапу українського державотворення. Особливе значення надається сутності виборів, які характеризуються низкою ознак, зокрема, формою прямої демократії, механізм формування органів державної влади й місцевого самоврядування, інструментом забезпечення народного суверенітету та демократич-ного політичного режиму, засобом легітимації влади, а також процедурою формування спільної волі громадян. Підтримується наукова позиція щодо важливості здійснення виборчого процесу через спеціалізовані органи — виборчі комісії, які є основою демократичного адміністрування, особливо в країнах із нестабільними або перехідними політичними системами. Зазначається, що виборче законодавство формується під впливом національних традицій реалізації демо-кратичних процедур. Визначено, що гарантування виборів включає правове, організаційне, інформаційне, фінансове та матеріально-технічне забезпечення, котре задовольняє всебічну та системну реалізацію виборчих прав громадян. У висновках наголошується, що забезпечення виборчого права як ключового елементу прямої демократії, яка виступає однією із основних форм народного волевиявлення, надає змогу громадянам реалізовувати свою роль як єдиного джерела публічної влади в процесі формування громадянського суспільства та врегулювання політико-правових відносин у державі. Також зауважено, що подальший поступ української державності в умовах сучасних викликів потребує системного вдосконалення виборчого законодавства, що виступає одним із головних завдань сучасної конституційно-правової науки.

The article highlights the legal aspects of the implementation of electoral law as an important element of the development of direct democracy in Ukraine. It is emphasized that elections are a constitutionally defined mechanism for the formation and verification of the level of trust between society and state institutions, which in turn are the fundamental principle of the functioning of a democratic and legal state, as well as an integral part of its constitutional system. Attention is drawn to the key features of electoral law, which are of great importance for understanding the peculiarities of the organization of the electoral process in the conditions of the mod-ern stage of Ukrainian statehood. Particular importance is given to the essence of elections, which are characterized by a number of features, in particular, a form of direct democracy, a mechanism for the formation of state authorities and local self-government, an instrument for ensuring popular sovereignty and a democratic political regime, a means of legitimizing power, as well as a procedure for forming the collective will of citizens. The scientific position on the importance of conducting the electoral process through specialized bodies — election commissions, which are the basis of democratic administration, especially in countries with unstable or transitional political systems, is supported. It is noted that electoral legislation is formed under the influence of national traditions of implementing democratic procedures. It is determined that guaranteeing elections includes legal, organizational, informational, financial and material and technical support, which satisfies the comprehensive and systematic implementation of citizens' electoral rights. The conclusions emphasize that ensuring the right to vote as a key element of direct democracy, which is one of the main forms of popular expression, allows citizens to realize their role as the only source of public power in the process of forming civil society and regulating political and legal relations in the state. It is also noted that the further progress of Ukrainian statehood in the face of modern challenges requires systematic improvement of electoral legislation, which is one of the main tasks of modern constitutional and legal science.
