Адміністративно-правове регулювання статусу Служби судової охорони

Abstract

Дисертацію присвячено дослідженню адміністративно-правового регулювання статусу Служби судової охорони. Найважливішою обставиною, що визначає актуальність теми цього дослідження, є зростання потреби з боку нашого суспільства в підвищенні якості судової діяльності. Безпека здійснення правосуддя є однією з ключових передумов функціонування правової держави, а організація захисту судової влади є пріоритетним напрямом державної політики у сфері безпеки. Проте статистика свідчить про факти втручання в судовий процес у вигляді порушень громадського порядку та безпеки в судах, невиконання розпоряджень головуючого, допущення зневажливої поведінки в судовому засіданні та їх зривів, блокування роботи судів, висловлювання образ та погроз на адресу суддів, перешкоджання виконанню ними професійних обов’язків, здійснення фізичного тиску на суддів та членів їхніх сімей, пошкодження їхнього майна тощо. Цим явищам запобігають співробітники Служби судової охорони – створеного в процесі реалізації судової реформи в Україні спеціального суб’єкта публічної адміністрації, що покликаний забезпечувати охорону судів, органів і установ системи правосуддя, а також безпеку суддів і учасників судового процесу.

The dissertation is devoted to the study of the administrative and legal regulation of the status of the Court Security Service. The most important circumstance that determines the relevance of the topic of this study is the growing need on the part of our society to improve the quality of judicial activity. The security of the administration of justice is one of the key prerequisites for the functioning of a legal state, and the organization of the protection of the judiciary is a priority direction of state policy in the field of security. However, statistics indicate facts of interference in the judicial process in the form of violations of public order and security in courts, failure to comply with the presiding judge's orders, contemptuous behavior in court sessions and their disruptions, blocking the work of courts, insults and threats against judges, obstruction of their performance of professional duties, physical pressure on judges and their family members, damage to their property, etc. These phenomena are prevented by employees of the Court Security Service - a special subject of public administration created in the process of implementing judicial reform in Ukraine, which is designed to ensure the protection of courts, bodies and institutions of the justice system, as well as the safety of judges and participants in the judicial process. At the same time, the administrative and legal status of the Court Security Service is characterized by fragmented regulatory regulation, the presence of gaps and conflicts, which negatively affects the effectiveness of its activities. In the science of administrative law, the issues of the administrative and legal status of the Court Security Service have not been sufficiently studied, since there are no special comprehensive studies of the problems of the administrative and legal status of the Court Security Service.
